Indenture, assignment of mortgage term.

1) Salona Edwards of Derby, widow of Nathaniel Edwards late of Derby, gent., dec'd., and William Charles Flack of Cavendish Bridge (Derbs.), gent., executors of will of Nath. Edwards, who was sole executor of will of Wm. Edwards late of Derby, gent., dec'd., who was trustee in respect of term of 500 yrs.

2) Rev. Thos. Gisborne, elder of Yoxall Lodge (Staff.), clerk, and Thos. Gisborne, younger, esq. oldest son and heir apparent of aforesaid T.G., elder, late student of Trinity College, Cambridge, now residing at Clifton p. Ashbourne.

Trustee appointed by (3) in respect of term of 500 yrs.

Reciting mortgage of 20 Feb. 1753, conveyance of equity of redemption and assignment of term of 500 yrs. by Edmund Turner to Wm. Edwards in trust for John Gisborne, to attend the inheritance, death of Wm. Edwards in Apr. 1800, (will dated 2 Jan. 1800 proved 9 July 1800), death of Nathaniel Edwards Jan. 1814, (will dated 21 Dec. 1801, codicil 13 Jan. 1814) indentures of lease and release dated 2, 3 Dec. 1808 and bargain and sale dated 5 Nov. 1808 (DD/BK/1/368), now (1) at request of (2) & (3) to (4) in trust for (3), capital messuage of John Gisborne with offices, buildings, courts, yards, gardens, fishponds, pleasure grounds, coach houses, stables and other buildings, (6a. 2r. 5p.) inclusive of messuage and yard, occ. Mr. Horrocks, in Bridge Gate, p. of St. Alkmund, Derby; part of Grove Close (14a. 3r. 22p.) with buildings, sheds, and erections, other part whereof having been lately sold to Wm. Strutt, land heretofore a roadway leading out of Kedleston turnpike road, opp. Lodge Lane, east, Kedleston turnpike road south, Duffield north west, the Grove, north; parcel of enclosed land or plantation of trees and shrubs called the Grove (1a. 1r. 35p.) with summerhouse; all in p. of St. Alkmund, late occ. John Compton esq., as lessee of (2), now Wm. Strutt; also Near Morley Close (5a. 0r. 27p.) and Far Morley Close (4a. 1r. 3p.) adjoining Grove and Grove Close, late occ. Mr. John Watson, now Wm. Strutt; also Near Cap Croft Close (1a. 3r. 35p.), Lodge Lane, south east, Kedleston turnpike road east or north east, late occ. John Watson, now Wm. Strutt; also parts of Middle Croft, White Stoop, Rye Flat, otherwise Parkers Flat, Closes, late occ. John Watson, now Wm. Strutt, boundaries given; also messuage in Bridge Gate late occ. John Horrocks now Wm. Strutt; also all other messuages, lands, buildings and hereditaments late of said John Gisborne, now (1) and (2) in p. of St. Alkmund between Darley Lane and Darley Grove east, Bridge Gate south, Kedleston and Duffield turnpike road west, and Morley Closes north; also tithes late of John Gisborne now of (1) and (2) in respect of properties above; also right and title of (2) and (3) or owner of above capital messuage to pew in church of St. Alkmund, for residue of term of 500 years, in trust to attend the inheritance.
