Description (What the record is about)
-
It is proposed that Robert Aglionby Slaney esq shall advance to Thomas Campbell Eyton £1400 at 3½% clear until the death of Mr. Eyton's father now aged 75, without any insurance of T.C. Eyton's life against the latter's; and that Miss Mary Slaney shall advance a further £600 (to make up £2000) at 4% clear but that Mr. T.C. Eyton should insure his life (45) against his fathers for £600 in the Minerva or some other office and keep up such policy of Insurance for the benefit of Miss Slaney until his father's death, when Mr. T. C. Eyton shall pay off the £2000; the interest, and the annual premium of the insurance to be secured by a charge upon £4141. 16, 0. red. 3% stock now standing in the names of Robert Burton and William Henry Slaney, surviving trustees in the settlement made on the marriage of Mr. T.C. Eyton and Miss Elizabeth Frances Slaney and dated 13th May, 1835, (a copy of which cannot be conveniently obtained at present if it can be dispensed with). It is proposed as this is a family arrangement that Mr. W.H. Slaney shall be named as a trustee on behalf of Mr. R.A. Slaney and Miss Slaney, and lend the money in his name; Mr. T.C. Eyton entering into a deed of covenant with him to repay at the end of 12 months (but it is understood that repayment shall not be till 6 months after the death of his father) and to pay the interest in the meantime and keep up the insurance for the £600. Mr. T.C. Eyton to sign an order to his bankers Messrs. Drummonds and co, who receive the dividends for him, on the £4141. 16. 0, to pay out of funds in their hands the interest on the £2000 and the annual premium on the insurance policy. The trustee, Mr. W.H. Slaney, to sign a short declaration of trust by indorsement, that the £1400 belongs to R.A. Slaney and the £600 to Miss Slaney. Should T.C. Eyton die before his father, Mr. R.A. Slaney will run the risque of his not leaving enough personal property to pay this and his other debts, and Miss Slaney will be secured in that event by the insurance. The original trustees in the settlement of 1835 were John Oliver Hopkins (dead) Robert Burton, W.H. Slaney, and John Eyton (dead). Marginal note - It has since been proposed to deposit Railway script instead of this insurance of the value of £600 if this will not involve Miss Slaney in any liability whatever--
