10 The inhabitants of Coldred have been accustomed from time immemorial to draw water from a pond in the highway in Coldred leading from Cowlered Forstall to Cowlered Mill in Coldred, for necessary use in their houses, but Thomas Jenkyn of Coldred, yeoman, intending to annoy them, on 1st April, 1600, placed a hedge around the pond, separating it from the highway, so that they have since then been prevented from drawing water.
Thomas Jenkyn comes by Herbert Cadman, his attorney, and claims that the indictment is insufficient in law, pleads not guilty, and puts himself on the country. John Webbe, gentleman, clerk of the peace, prosecutes. Writ of non omittas...... quin venire facias to summon a jury for session at Maidstone on Tuesday before Michaelmas [23rd September, 1600]. Mathew Spensocke of Westgate, yeoman, and William Wreight of Elham, yeoman, become sureties for William Knight in the sum of £10 each. On which day at Maidstone, [as above].
11 William Knight of River, yeoman, since 1st May, 1600, at River, has been a common barretor and disturber of the peace.
