Probate of will of Thomas Braithwaite of Ambleside, esq. made 9 November 1674 and proved (prerogative court of York) 3 May 1675.
Bequests include:- desire for body to be buried in Grasmere church;
- Ratifies settlement of his Yorkshire estates made 10 June 1657 and 18 April 1671;
- To sister Dorothy Sandes, confirmation of conveyance to her 10 April 1671 of customary messuage lands and tenements in Ambleside, and further conveyance of other customary lands in Ambleside 12 April 1671;
- To brother Robert Braithwaite, messuage, land and tenement with appurts. situate at Law Wrea in Furnessfell, Lancashire, whether customary or freehold, lately purchased of James Braithwaite, also customary messuages and lands at Pulbecke and Breathey and all other customary lands in bailiwick of Hawkshead, Lancashire; if however testator's niece Lady Elizabeth Otway pay £700 to Robert within 1 year than said messuages and tenements to go to her; then £250 of said £700 is to be used to maintain 2 poor scholars at St Johns College Cambridge, from schools in Kendal and Hawkshead, until they are Masters of Art; also to brother Robert, all lands at Fryermosse and in the Forest of Quinmoore, Lancashire (12 acres); also manor of Baisbrowne and rents and services from tenants of lands called Gilpinslande, Langdale, and yearly rent charge from John Benson's land at Elterwater;
- To noble friend Dr Barloe, provost of Queens College, Oxford, in trust for said university "all my ancient Medalls and Roman antiquities of gold, silver, brass and copper";
- To stock of Ambleside Chapel, £10, and £10 for buying 2 silver chalices for use upon communion days;
- To wife Margaret Braithwaite, £300 all plate, linen, household stuff in her possession at Bowleinge Hall, also money due to testator out of sale of Stapleton, about £200, in lieu of widowright, also his best silver tankard;
- To Mayor, aldermen of Kendal, £10, to purchase piece of plate for their use;
- To nephew Parson Wilson and wife, £5; and to their son Thomas testator's God-son £10;
- To sister Braithwaite of High House, £5 and her daughter Dorothy Braithwaite £10;
- To nephew Thomas Sandes and wife, £5 and their son, Thomas, testator's God-son, £10;
- To nephew William Sandes and his son, testator's God-son, each £5;
- To nephew Samuel Sandes, £5;
- To much honoured cousin, Sir John Penraddocke, a gold ring "as a remembrance";
- To any living issue of uncle Anthony Penruddocke esq., £10, as a remembrance of my said unkle dear love and kindness to me;
- To cousin, Jane Wilson of Faild Head, £10, and her daughter Elizabeth testator's god-daughter £5;
- To cousin, Mary Braithwaite of Catterick, [Yorkshire], £10;
- To cousin, Mrs Barbara Fleming of Rydal, £10;
- To niece, Lady Elizabeth Otway, bible which "my cousin Preston of Holker gave to my father with my cousin George Preston and my unkle Thomas Brathwaite their pictures therein" and she to have a special care of it;
- To son of Lady Otway, Braithwaite Otway, a gold ring and picture of the Creation and the sweet counter in the parlour, to be kept as heirlooms in testator's house;
Executors: brother Robert Braithwaite, sister Dorothy Sandes, niece Dorothy Braithwaite daughter of deceased brother William of Newcastle [Northumberland].
Supervisors: cousin Danield Fleming of Rydal esq., cousin Richard Braithwaite of Warcop esq., Mathew Richardson of Roanhead esq. and brother Edward Wilson of Dallam Tower.
