(1) Margaret Davies of the Newhouse, pa. Stretton Grandison [Grantham] widow, Richard Hopton of Canon Frome, esq., James Pool of Stretton Grandison, clerk, and Thomas Haylings of Much Cowarne, tanner, executors of last will of Thomas Davies, esq., of the Newhouse, decd.
(2) Humphrey Eliot formerly of London, mow of Brockmanton, co. Hereford, lapidary.
(3) Joseph Burnam of Hatfield, co. Hereford, gent, and Higinson Ash of Buckland co. Hfd. gent.
(4) Nehemiah Collins of Stoke Lacy, gent.
Reciting (a) Assignment
Mortgage by lease and release 1, 2 November 1737
(1) Sir George Caswall of the city of London, kt.
(2) Humphrey Elliot
(3) Executors of Thomas Davies
(1) to (3) at direction of (2) and (2) to (3)
Property as below.
Proviso for redemption on payment of £510. 12s. 6d. to (3)
(b) Default was made, and Humphrey has agreed with Nehemiah Collins for absolute sale for £960.
Now (1) to (3) at direction of (2) and (2) to (3)
All that capital messuage and farm with outbuildings, lands, appurts. etc. in the township of Brockmanton in Puddleston, a cottage with barn, garden, and 1 acre land in Brockmanton, certain yearly rents issuing out of Coxes Farm at the While, pa. Puddleston, the White Farm, in Puddlestone, Little Meadow in Puddleston and Kimbolton, and all other rents payable on any demise or grants of the premises.
To (3) in trust:
As for 1 acre of land whereon Humphrey has erected a messuage barn and buildings, together with the said new messuage, barn and buildings, garden and little hopyard adjoining; 1 acre land in a common field called Turning Elone Field, in Puddleston, 1 acre land in a common field called the Elone Field, and called the Wett Reans, and 1 acre land adjoining the roadway from the capital messuage to a messuage of Howell Yeomans; and the cottage barn garden and 1 acre land mentioned above, to use of (2) forever.
As for the capital messuage and all other lands and yearly rents etc. to use of (4) forever.
Also Release (2) to (3)
The manor or reputed manor of Brockmanton, with rights and appurts.
To use of (4) forever
