Whereas by indenture of settlement August 8th 1747 between Daniel Austin 1st part, Anne his wife, then Anne Sandford spinster of Shrewsbury, daughter of Humphrey Sandford and Rebecca Walker, both deceased 2nd part, and Humphrey and Folliot Sandford 3rd part, reciting that a marriage was to be solemnized between Daniel Austin and Anne and that Daniel Austin was in possession of a receipt for making a composition liquor called Daffys Elixer, the profits from the sale of which had over the several years past amounted to £100 and more. And that Daniel Austin, if the intended marriage should take place, would become entitled, through his wife, to one undivided sixth part of a copyhold messuage to be situated in Little Stretton, also to £900 in money or securities for money, £300 part of which is recited to be secured to Anne Sandford as one of the younger children of Humphrey Sandford, by indenture January 10th 1717: (trustees created for raising £2000. See 465/584 ). In consideration of the intended marriage and of the marriage portion of Anne Sandford, to which Daniel Austin would become entitled, if the marriage shall take place, Daniel Austin granted to Folliot and Humphrey Sandford the receipt or nostrum for making Daffys Elixer with the full liberty for making and vending the same and of using the seal and name of Charles Trubshaw, as before used by Daniel Austin for the better selling of the liquor; to receive and take the profits of the sales by Humphrey and Folliot Sandford, upon trusts, :- they should permit Daniel Austin to receive the profits until the day of the intended marriage, and to the use of Daniel Austin for his life. If Anne his intended wife shall survive her husband, Humphrey and Folliot Sandford shall from the profits and sales of the liquor raise an annuity of £60 to be paid yearly to Anne for her natural life, following the death of Daniel Austin. If Anne should survive her husband and have no issue, a further annuity of £20 shall be paid to her from the profits of Daffys Elixer, at the four quarter days. After the payment of the annuities the profits from Daffys Elixer to be used for the sole use and benefit of any child or children of Anne and Daniel Austin. Whereas it was agreed the sum of £300, part of the fortune of Anne Sandford under the settlement of her late father and mother, should be assigned for the benefit of the marriage, and a sixth undivided part of the copyhold messuage in Little Stretton should be sold, and the money from the sale and the £300 to be laid out to interest or in the purchase of an estate of inheritance, and the interest or profits of the estate for the benefit of Daniel Austin and Anne his wife and their issue. Witnessed that for consideration of the intended marriage, and for the assuring £300, due and secured to Anne Sandford, by the marriage settlement of Humphrey Sandford and Rebecca Walker, and in consideration of 5s. paid by Folliot and Humphrey Sandford to Anne Sandford, release by Anne Sandford of £300, and of all rights, title etc. in the messuages, lands, etc. chargeable with the payment of £300. To hold by Humphrey and Folliot Sandford on the trusts mentioned. Agreed between the parties that Anne's 6th part in the messuage called the Hall in Little Stretton, and in all parcels of ground belonging, should be sold to the best bidder, and the money received by Humphrey and Folliot Sandford for the several uses. For the purchase of a freehold estate, the rents and profits of which to the use of Daniel Austin during his natural life, then to the use of Anne Sandford, and after her decease, Humphrey and Folliot Sandford, as executors and administrators should apply the £300 and money from the sale of the sale, not laid out in purchase, to the use of any children of Daniel Austin and Anne Sandford, in default of such issue, to the use of the heirs of Daniel Austin. Further agreed that the 6th part of the property in Little Stretton, until sold, and its rents and profits, should be applied for the same uses as the proceeds of the sale. Provided that it shall be lawful for Daniel Austin, in the presence of 2 or more witnesses to revoke any provision made in present agreement, and to make with the consent of Anne his wife, or Humphrey or Folliot Sandford, any new uses concerning the premises. Whereas since the marriage of Anne and Daniel Austin the £300 has been received, and the property in Little Stretton sold, and £200 from the sale has been received by Daniel Austin. Daniel Austin, now desirious of revoking all trusts and uses made above, concerning the premises, and to have absolute right and interest solely vested in himself, to the intent that he might sell the property as he should think fit, with the consent of Anne, his wife, Humphrey and Folliot Sandford and witnesses, has revoked all uses, trust, clauses and covenants made previously concerning the premises. He declares that the profits from the sale of Daffys Elixer, the sum of £300, £220 as received, shall be soley vested in Humphrey and Folliot Sandford, who shall be possessed of every part. In trust for Daniel Austin, his executors and administrators for their own proper uses, and that settlement of August 8th 1747 void.
