Further information: Mr Brader had an accident on 4 July 1955 when employed as a coal face worker (filler). He returned to work a month later on a trial basis but found he was unable to do the work. He was awarded Special Hardship Allowance in addition to sickness benefit. He again attempted to do his pre-accident job but was admitted to Firbeck Rehabilitation Centre on 12 March 1956 for treatment to his back injury. He was there until 6 April 1956 when he returned to work as a transfer point attendant. He made a claim to Special Hardship Allowance from 11 April 1956 on the basis that his new role was not of an equivalent to his usual occupation. The question of wages was raised, with Mr Brader stating he was not earning as much in his new employment. His employers' stated that as he was not working all the shifts available to him, his current earnings (£11 5s 10d average) were more (in the 6 weeks up to his accident he earned between £6 9s 10d and £12 11s 3d). The matter was to be heard on 22 June 1956 at a tribunal but this was adjourned for more information relating to 'sick notes.' Notes dated 22 June 1956 state 'Pre-accident job packer and drawer-off occasional filler and now gear head attendant.' There are comprehensive wages details for Mr Brader in additional information for the tribunal. When the appeal was heard on 25 July 1956 Mr Brader was found in favour of. A note is made that he had '16 periods of illness in pre-accident average period'. 'Industrial Disablement benefit' is entered onto the Tribunal form. -
