Statement of case for the plt in the case of Richard More, esq., versus Edward Lord Herbert deft.
Copy of 1037/2/13 but notes on the dorse are different.
For the deft. In Domesday it is called the Manor and Hundred of Cherbury. 7 E VI the King grants.
4 R II Hundred of Cherbury Henry of Winsbury did fealty to the Lord.
19 R II The great hundred there. Shelve in the margin present that John (blank) who ought to appear. I Mary - Cherbury Manor &c. Curia Magna of Ed. Ld. H. Lord of the said Manor or hundred.
19th October, 31 H. VIII Cherbury hundred ordered by the great quest that no man within the hundred overpress the common. Title - the great Hundred there. Shelve, the township there do present there Howell ap David put a horse and colt an estray, and also the way obstructed and that Thomas Davis had incroached upon the common there March 19 R II. Cherbury. Jurors present that the Earl of Stafford inclosed 500 acres in Aston Piggott although the tenants had common there, and the Earl of March used to hunt, license not being obtained to do it.
13 Eliz. Present an inclosure of 6 acres in Mucklewick.
Shelve villate, the township and represent Thomas Ward and others for default of Court and that Howell had enclosed waste lands.
27th October. 40 Eliz. the great Court there and turn of the sherriff. Shelve. Floyd Ward present several for default and for oppressing the common there and rescuring a more, for refusing to present the burning and batting the common.
4 James. Shelve the township present John Howell and others for default and present him constable. Francis Bennett for inclosing 2 acres and John Ward 4 acres.
8 James Shelve present defaults of Court and the inhabitants for inclosing 4 acres in White gritt and Shelve mills.
12 James Shelve. Lewis Waters for inclosing there 2/- amercement.
26th October 12 James, Estreats of the Hundred etc., Lewis Waters, 2/-. 15 James. Shelve, Estreats of Francis Bennett Lee Clark Howell for watering hemp. Francis Bennett 3d. Waters, Howell 1/- for inclosing part of the common.
4th October 7 Charles. fo 11 Charles Ward's fine remitted.
9 Charles. 24 ?s. remitted on petition to the Lord.
Shelve received of John Ward for inclosing 40 acres 40/-./ received £2. / received 12/-. / received for the same of Hugh Ward 5/- part of 10/- of Lewis Powell for inclosing 12/-11 Eliz: Action brought for trespass done infra juriadictionem Curie.
