1. Deed of Covenant between Timothy Seymour of Shrewsbury, mercer, of one part, and Richard, Joseph and Elizabeth Russell on other part. July 11, 1695.
By indenture January 1st 1695/6 Timothy Seymour mercer, son of Timothy Seymour, Mary Seymour widow of Timothy Seymour the elder, daughter and heir of Richard Charleton, Elizabeth Seymour, wife of Timothy the Younger, one of the daughters of Richard Russell of London, merchant, Thomas Perkinson of Bishops Castle Doctor of Physics, Margaret, wife, one of the daughters of Timothy Seymor the elder John Jennings of Shrewsbury grocer, and Anne his wife, daughter of Timothy Seymour the elder, Samuel Travers of Shrewsbury and Hester his wife, daughter of Timothy Seymour the elder, Ebenezer Travers of London, merchant and Sarah his wife, daughter of Timothy Seymour, of the one part, and Richard Russell, and Joseph Russell son and heir apparent of Richard on the other part. Timothy Seymour the elder, in consideration of a marriage lately solemnized between Timothy his son and Elizabeth his wife, and £1,200 paid as the marriage portion of Elizabeth, and for the conveyaing, settling, and assuring of the capital messuages, mesne lands, tenements therein mentioned, to such uses as are expressed following certain covenants, dated July 11th last before the marriage.
Above persons for themselves and respective wifes did covenant and grant to and with Messers. Richard Russell and Joseph and Russell and their heirs that they Timothy Seymour, and Elizabeth his wife Thomas Perkinson and Mary his wife etc. shall before the end of the next Easter term levy fine amongst other houses, lands, premises, of all the capital messuage of Up Rossall, with appurtenance containing in all 168 acres of arable meadow and pasture land, which fines to be levied should enure to such users on such trust and for intents and purposes as are expressed:- All tenements or hereditaments (except the capital messuage of Up Rossall) to the use of Timothy Seymour for his natural life. The said capital messuage to the use of Timothy Seymour for 99 years, and after the determination of the estate to the use of Richard and Joseph Russell and their heirs during the natural life of Timothy Seymour; upon trust, to preserve the contingent uses and to permit Timothy Seymour to receive the rents during his life.
For the capital messuage in the Isle after the determination of the several estates thereof limited to the use of Richard Russell and Joseph during the life of Elizabeth, wife of Timothy Seymour; in trust to pay Elizabeth £100 p.a. out of the rent. Upon further trust to permit the residue of the rents of the lands, hereditaments (capital messuage excepted) to be received for the benefit of such persons to whom the next immediate reversions of those premises for the time being expectant. The residue of the rents of the excepted capital messuage, after the payment of £100 to Elizabeth, to the benefit of the male heirs of Timothy Seymour and their executors. In default of male heirs to executors of Timothy with proviso that if Timothy or Elizabeth his wife settle any freehold lands and premises, of yearly value £120, for her life and in lieu of dower, in trust for the true payment of £100 yearly sum, then the use of and in the lands and premises (except the above capital messuage) should cease and Joseph and Richard Russell should stand seised of the said capital messuage, upon trust to permit the heirs male of Timothy Seymour, or his executors to receive the rents of the capital messuage during the life of Elizabeth. To the use of the heirs male of Timothy Seymour in order of seniority. In default of such, to be divided into 4 equal portions to the use of the sisters of Timothy Seymour, wives of Mr. Thomas Perkinson, John Jennings, Samuel Travers, and Ebenezer Travers, and their heirs.
2. Lease and Release January 2nd 1723/4 Timothy Seymour, son and heir of Timothy Seymour and Elizabeth, of capital messuage in the Isle to William Travers and Edmund Pateshall gent. to make them tenants of the praecipe in order to suffer a recovery, the uses whereof are declared to Timothy Seymour in fee.
3. Hilary Term 1724. Recovery suffered of the capital messuage and premises.
4. By Indenture tripartite, May 9th 1741. Between Timothy Seymour and Elizabeth his wife of 1st part, Thomas Lee of Wroxeter, 2nd part, Margaret Lee of Wroxeter, spinster, sister of Thomas 3rd part. Consideration £1,100 paid by Margaret Lee to Timothy Seymour and his wife. Granted and demised to Margaret Lee, and heirs and assigns, all that capital messuage in the Isle. Duration 1,000 years. Proviso that on repayment of sum and interest, residue of the term should cease. In which mortgage deed, among other covenants, is one by which Timothy Seymour and Elizabeth his wife do covenant to levy a fine of the capital messuage in the Isle, before end of next Trinity term, to Thomas Lee and his heirs which fine when levied should be to the use of Margaret Lee during 1,000 years. 2 chirographs of a fine levied accordingly.
5. By indenture June 17th 1741. Timothy Seymour of 1st part, and Margaret Lee of 2nd part. In consideration of £200 paid by Margaret Lee (after reciting the mortgage dated May 9th 1741) charged the said capital messuages with the repayment of £200 and interest, and £1,100 and interest.
6. By indenture dated March 20 1741, between Timothy Seymour and Margaret Lee; consideration £700, paid by Margaret Lee, after recitation of the 1st mortgage deed of May 9th 1741, and the 2nd mortgage deed of June 17th 1741, as also several bonds for the due performances of covenants and charges, the said capital messuages with the repayments of £700, and interest, as well as £1,100, and £200, making £2,000.
7. By indenture, April 13th 1743 between Timothy Seymour, and Margaret Lee; consideration £200 paid by Margaret Lee, after the recitation of mortgage deed of May 9th 1741, and that Timothy Seymour had borrowed several sums of money from Margaret Lee, which were due and owing, upon the aforesaid security, as by his bond for performance, charges the capital messuage in the Isle with further £200 and interest.
8. Indenture dated August 1st, 1745 between Timothy Seymour and Margaret Lee. Timothy Seymour recited several mortgage deeds, borrowing several sums, and 2 several bonds from Timothy Seymour to Margaret Lee, and that on account stated, due to her for principals and interest £2,764 9s. 9d. Timothy Seymour had occasion to borrow further £100 to discharge debt, making £2,864 9s. 9d. For better securing of payment and interest grants and conveys to Margaret Lee, the pool called the Isle Pool, to be excepted out of the several securities. A newly erected messuage near the capital messuage for 1,000 years, with proviso that on repayment of £2,864 9s. 9d. and interest to Margaret Lee the residue of the terms should be void.
9. By indenture, dated 18th and 19th October 1748. John Ingram of Coventry doctor of Physic of the first part Timothy Seymour, draper of Shrewsbury, now of London draper and mercer, 2nd part, Margaret Lee of Wroxeter 3rd part, John Stanier of Uppington Salop 4th part. Recitation of mortgage deed of August 1st 1745 between Timothy Seymour and Margaret Lee, for securing principal sum and interest £2,864 9s. 9d., and reciting that by indenture of lease and release, 30th and 31st July 1746 between Timothy Seymour, 1st part and John Ingram 2nd part, consideration: therein mentioned. Timothy Seymour conveyed to John Ingram several lands and hereditaments; proviso, redemption for premises upon payment of £350 and interest. If interest not paid to John Ingram estate to become absolute in law to John Ingram. Mortgage recited £3156 due from Timothy Seymour to Margaret Lee, John Stanier's agreement to purchase the inheritance therein comprised for £3156. Grant and release by John Ingram to John Stanier of that capital messuage, in the Isle, and the pool called the Isle Pool.
Consideration £3156 paid by John Stanier to Margaret Lee, and 10s. 0d. to Timothy Seymour and John Ingram.
10. 4 part indenture. March 23rd 1748/9 Margaret Lee, 2nd part John Stanier, 3rd part Humphrey Sandford of the Isle, 4th Thomas Harries of Cruckton. Several mortgage deeds recited of Timothy Seymour, of messuages, lands, and hereditaments. Agreement between John Stanier, who had purchased the inheritance of the premises, and Mr. Humphrey Sandford of the Isle, for sale of the estates and premises for £3276. Margaret Lee, in consideration of £3150 paid to her by Humphrey Sandford, as principal and interest on premises,ageed inheritance of premises to be conveyed to Humphrey Sandford; Further consideration: 10s. 0d. paid by Thomas Harries to Margaret Lee. Bargain and sale by Margaret Lee, by consent and direction of John Stanier and Humphrey Sandford, to Thomas Harries, of all premises, messuages, pool lands etc. in the Isle. To hold by Thomas Harries for 1,000 years, and 1,000 to come, in trust for the benefit of Humphrey Sandford, his heirs and assigns.
11. By indenture of lease and release, March 23rd and 24th, 1748/9 between John Stanier, and Humphrey Sandford. Bargain and sale by John Stanier to Humphrey Sandford, consideration £3276, all the capital messuage and other premises in the Isle, estates of Timothy Seymour.
Executed by John Stanier with a receipt signed by John Stanier on the back of this deed.
12. March 25th between Humphrey Sandford, and John Stanier, in securing £1260 and interest.
