Description

Indenture between Charles Walcot of Walcot, esq., and Humphrey Walcot of Stanmore, Middx., esq. Whereas by indentures of lease and release of 20 & 21 January 1696/7, the release being in 4 parts, between 1. John Walcot snr. of Walcot, since decd., and John Walcot jnr., 2nd son, 2. John Tayleur of Rodington, and Ann Tayleur, spinster, since decd., daughter of John Tayleur, 3. Charles Baldwyn of Bockleton, Worcs., esq., since decd., Humphrey Briggs of Haughton, Salop, esq., son and heir apparent of Sir Humphrey Briggs, bart, Richard Corbet of Moreton Corbett, esq., William Tayleur, son & heir of John 4. John Chetwood of Oakley, Staffs, esq., and John Lacon of the West Coppies, Salop, esq., since decd.

In consideration of a marriage to be celebrated between John Walcot jnr. and Anne Tayleur, and of £2000 to be paid by John Tayleur as the marriage portion, grant and release by John Walcot to Charles Baldwyn, Humphrey Briggs, Richard Corbett, William Tayleur and heirs of the manor of Sibdon, and several messuages in the occupation of Charles Bird, John Jordan, Thomas Tipton, Edmund Carter, Thomas Bird, Samuel Nethway, John Oliver, John Griffiths, Richard Weaver, Thomas Robinson, William Jordan, Henry Russell, Evan Anthony and John Mathews, and appurtenances belonging, and the parochial chapels of Edgton and Sibdon and the impropriations and tithes of both places, and all glebe lands and advowsons of Edgton and Sibdon Carwood, of John Walcot, and several pieces and parcels of land called Stockin lands and Slang in the townships of Brcom and Rowton, then in the possession of Thomas Tipton, and a messuage in the township of Whitcott Keysett in the parish of Clun, late in possession of William Phillips, and hereditaments belonging, and one sheep walk upon the Ridings in the Forest of Clun, late of Edward Bowen of the Bryne, in Clun, and of all messuages, cottages, et. of John Walcot in the territories of Sibdon , and all right, title and interest, etc. in the same. To have and to hold by Charles Baldwyn, Humphrey Briggs, parties to the quadrupartite indenture, to the use of John Walcot snr. until the proposed marriage should take place, after the solemnisation, to the use of John Walcot jnr. for the term of his natural life, and for the sons of John Walcot and Anne his wife, for 500 yrs; in default of such issue to the use of John Chetwood and John Lacon, that the executors of the survivor should, out of the rents and profits of the premises, levy to pay for marriage portions for such daughters, viz: if one daughter £2000 for portion, if more than one £3000 to provide marriage portions, to be equally divided, to be paid to daughters of John Walcot and Anne Tayleur within 21 days of marriage, with the consent of John Tayleur who shall raise £30 for the maintenance of such daughters until the marriage portion is paid. If any other person by virtue of the present indenture should secure to the good liking of John Tayleur the portions and maintenance, and discharge the costs of John Chetwood and John Lacon, the term of 500 yrs. to cease and other clauses, covenants, etc. to be void. Whereas John Walcot the younger died with no male heirs but 3 daughters, Letitia, Sarah and Anne. Whereas all premises mentioned in indenture descended to Charles Walcot, brother and heir to John Walcot. Charles Walcot in consideration of £3500 paid by Humphrey Walcot, granted and conveyed to Humphrey Walcot all premises contained in above indenture. To have and to hold by Humphrey Walcot and his heirs, subject to a term of 500 years in his possession by a lease to Humphrey for one year from the day before the sealing of these presents.

Covenant by Charles Walcot and Bridgett his wife to levy a fine Sur Cognizance de droit before Michaelmas next for the above premises. Guaranteed to Humphrey Walcot, free from all incumbrances, except the raising of marriage portions for daughters of John Walcot , the term of 500 years, and leases made by John,snr., or Charles Walcot made a year before this indenture.

Sealed and signed by Charles and Humphrey Walcot.

Sealed and delivered by Humphrey Walcot in the presence of William Hagar, Richard Baldwyn, and by Charles Walcot in the presence of J. Walcot, Allen Stanley.
