1. John Carline late of the Abbey Foregate, now of Skellingthorpe, Lincs. gent.
2. Richard Carline of Lincon, gent.
3. Daniel Rowland of 28 Grosvenor Place, Middx. only brother, heir and executor of the Rev. Wm. Gorsuch Rowland late of the Abbey Foregate.
By an indenture of Release (Lease and Release) 20 December 1833. between John Carline the elder Master Builder, since decd.
(1) John Carline party to the present deed.
(2) Wm. Evans of Hadley Park, Salop, esq. since decd. & Wm. Gorsuch Rowland.
(3) Reciting that John Carline the elder was seised of messuages and of a moiety of 3 stables in the parish of S. Chad for the rest of a term of 99 years created by indenture of 2 April 1792, and the said John Carline was also possessed of a considerable personal estate, consisting of 8 shares in the Shrewsbury Gas Company, a debt of £411.9. due from John Pearson then Advocate General in India, household goods and furniture in the messuage in Abbey Foregate in his occupation, and of stock in trade books etc. belonging to his late sone Wm. Carline, Iromonger who dies intestate, of whose goods letters of administration had been granted to John Carline.
And also reciting that the business of a marble and stone mason had for some time past been carried on at the Abbey Foregate in the names of J. Carline the elder and J. Carline (party) as co-partners, the elder being a nominal partner only the profits and losses being borne by his son. And reciting that the hereditaments in the occupation of John Carline the elder, John Carline, party, John Hawkesworth, Thos. Vaughan, Thos. Daniels, and Wm. Wycherley were subject to a mortgage for securing to Wm. Wybergh of Shrewsbury gent 2 several sums of £1000 and £1000 and to a mortgage to the Company of Burton Lloyd Salt & How Bankers in Shrewsbury for securing the balance due on the said co-partnership account to the Bankers. The hereditaments situated opposite the Mill Pond in the occupation of Wm. Chilton, Edward Richards, Edward Jarvis, Charles Blair, Mary Thomas, Francis Baxter & .... Hitchin, and the hereditaments at Judith Butts & at the back of the workshop of John Carline (party and in the occupation of John Carline, elder) were subject to a mortgage for securing to Edward Mansell of Shrewsbury, gent, £1200 - which mortgage was in fact made to John Price, gent. and Saml. Tudor, upholstere of Shrewsbury.
And further reciting that John Carline the elder was indebted by bond to Thos. Cotton and to his son-in-law Jas. Whitney in the 2 several sum of £500 each.
And reciting that John Carline had promised to pay his son-in-law Philip Corbet and to his 2 unmarried daughters Mary Carline and Ann Carline £500 each, but had given no security.
And reciting that John Carline agreed to convey all his real and personal estate to W. Evans & W.G. Rowland to certain uses, in consideration of the advantages of which J. Carline (party) took upon himself the payment of the several sums of £500 each to Philip Corbet and to his sisters, and to enter into a bond to each of them. He had also agreed to enter in to a bond to the said W. Evans and W. G. Rowland for securing to the J. Carline the elder and his assigns during his life £300 p.a. and to Mary wife of J. Carline (should she survive him) the like payment of £300 p.a.
And 7 messuages in the parish of Holy Cross & S. Giles opposite the Mill Pond in the Abbey Foregate, measuring in front towards the street 66 feet 3 inches and in depth from the street towards the Gays 222 feet, then late in the several occupations of Edward Hammonds, Richard Wahite .... Perks, Eleanor Head, W. Richd. Humphreys, Jno. Ward and Robert Davis but then of Wm. Chilton, Edwd. Richards, Edwd. Jervis, Chas. Blair, Mary Thomas, Frances Baxter & .... Kitchen.
And all that close piece called Bryan's Croft, containing 2 acres 3 roods 24 perches, near Judith Butts in the parish of Holy Cross, formerly in occupation of John Rawlings, Saml. Scoltock, since of Josh Meire later of Edwd. Studley and then late of Wm. Brayne, but then of the said Jno. Carline.
And also all that piece of land containing 1 acre 3 roods 24 perches near the same, being part of a field called the Lower Gay site near the Abbey Foregate behind the workshops of Jno. Carline (party) then or then late in the tenure of Jno. Carline.
To the use of J. Carline the elder for his life, and afterward to W. Evans and W. G. Rowlands upon trusts. Carline also assigned to them that undivided moiety in 3 stables in Claremo Mews in the parish of S. Chad., and all other personal estate except ready money, wearing apparel and personal ornaments for the rest of the term of 99 years subject to the one moiety of the rent payable.
The uses as follows:
The household goods upon trust for J. Carline the elder, the sale of the moiety if leasehold premises as were saleable, and to use the money in payment of J. Carline's debts, and to assign anything remaining unsold after this done, to J. Carline.
J. Carline the elder died 8 December 1834, Mary his wife died 5 January 1838.
Wm. Evans died 5 January 1850.
W. G. Rowland died a bachelor 28 November, 1851, leaving his brother Daniel his survivor.
By indenture of 31 December, between Robert Burton of Longnor Hall and Thos. Salt gent. (1), Daniel Rowland as heir (2), Joseph Wigley and Chas. Wigley accountants (3), Robert Burton, Wm. Butler Lloyd of Monkmoor. Thos. Salt, Wm. Wybergh How and George Moultie Salt of Shrewsbury & Thos. Maynard How of Shrewsbury as Bankers in Co-partnership (4), and John Carline (party) (5), Wm. W. How (6), Rd. Carline (7), Mary Mytton of Venus Bank, Cound, spinster (8), Harriet Wilson of Shrewsbury (9) and the Shrewsbury and Hereford Railway. In consideration of the purchase money of £1800 paid to Rd. Carline by the Railway Co. with the consent of the 1, 2, 3, 4, 8 and 9 parties and by direction of Jno. Carline (party) all those messuages comprised in a schedule to the indenture, Nos. 13, 15, 23, 24, 25, 29, 33, 30, 31, 32, 35, 48, 49, 50a in Holy Cross and S. Giles in the plans of the Railway Company deposited in the office of the Clerk of the Peace for Salop. To the uses of the railway according to the act of 1846. The sale was made by Daniel Rowland in pursuance of the trust, and by Jos. Wigley & C. Wigley so that £1400 should be the consideration for such of the hereditaments as were comprised in a term of 1000 years vested in W. W. How far securing £1000 formerly belonging to Thos. Gough and £1000 which belonged to Mary Mytton and for other parts of the hereditaments comprised in a mortgage for 1000 years for securing £1200 belonging to Harriett Wilson, all which mortgages were subsisting 20 December 1833, and paid off by Rd. Carline out of his own proper moneys. £400 was the sum for the purchase of such of the hereditaments contracted to be sold by Jos. Wigley & C. Wigley.
The principal sums secured to Thos. Cotton and Jas. Whitney by bonds were long since paid. By Jno. Carline (party).
By an indenture of 31 December last between Robert Burton & Thos. Salt (1), Daniel Row and (2), Philip Corbet (3), Mary Carline (4), Ann Carline (5), Jos. Wigley & Chas. Wigley (6), Robert Burton, Wm. Butler Lloyd, Thos. Salt, Wm. H. How, Geo. M. Salt, & Thos. M. How as Bankers in co-partnership (7), John Carline (8), W. W. How (9), Mary Mytton (10), Harriett Wilson (11), Rd. Carline (12).
For the payment by Rd. Carline of the principal and interest moneys due on mortgages and payment to the Bankers and payment to the Bankers and payment to Philip Corbet of £852. 3. 6. due on his bond, and to Mary Carline and Ann Carline £500 each due on bonds - altogether £5268. All properties except those sold the Shrewsbury & Hereford Railway company were conveyed to the use of Rd. Carline, and the moiety of the 3 stables in Claremon Mews assigned to him for the remainder of the term of 99 years.
John & rd. Carline agreed to indemnify Daniel Rowland.
Now. John and Richard Carline discharge Daniel Rowland of all trusts etc. and agree to indemnify him. R. Carline will produce on demand the indenture of 31 December last.
