1. Samuel Ward of Maesbrook, gent., only son and heir of Samuel Ward, gent. decd. (Samuel Ward the father) who was the eldest son and heir of Samuel Ward, gent. decd., (Samuel Ward the grandfather)
2. John Edmunds of Fernhill, gent.
Reciting Samuel Ward grandfather bought the tithes arising from certain estates called Ty brith and Llwynygo in Kinnerley. The estates were by various settlements and particularly Indentures of 6 & 7 April 1815 limited to divers uses in favour of Samuel Ward, grandfather, for life, remainder to son Samuel Ward in tail, on whose death to Samuel Ward party by deed poll of Samuel Ward, father, 10 May 1815 2 pieces of land (5a. 26r. and 2a. 3r. 4p) on Wern Issa in township of Lower Maesbrook, Kinnerley, lately allotted to Richard Croxon as right of common belonging to his freehold lands in the same township; all that piece of land (1a. 2r. 35p.) called Maes y freed in township of Tir y coed, parish of Kinnerley (then Samuel Ward, grandfather, and William Mansell) which 3 pieces had been received in exchange from Richard Croxon, whereby Samuel Ward the father in pursuance of a power vested in him for that purpose limited and appointed (subject to a life estute of Samuel Ward grandfather therein) to the use of Samuel Ward father in tail general, with proviso enabling Samuel Ward father with Samuel Ward grandfather to revoke all the uses and make new ones.
By Indenture of 28 Oct. 1815 Samuel Ward, father, and Samuel Ward, grandfather, did as to half of the 3 pieces revoke the uses limited it to other uses.
Samuel Ward, father, died in lifetime of his father, leaving Samuel Ward party only sone and heir.
By lease and release of 19 & 20 Sept. 1833 between Samuel Ward, grandfather (1) Thos. Ward and Edw. Rogers (2) reciting it was agreed between Samuel Ward, grandfather, and Samuel Ward, father, that Samuel Ward, father, should exercise his power of appointment over the other ½ in favour of Samuel Ward, grandfather, in lieu of the tithes of Ty brith and Llwynygo, but Samuel Ward, father, died before such arrangement carried into effect. Samuel Ward, grandfather, wished to carry it into effect for the benefit of his grandson, Samuel Ward party, so Samuel Ward grandfather released and assigned the undivided ½ of Samuel Ward, grandfather, of a messuage called Berthandeg with the said pieces of land received in exchange from Richard Croxon and the other lands occupied with same and of other houses, garden and lands in township of Llwyntidman, and the whole of the tithes arising from Tybrith and Llwynygo, and certain personal estate of Samuel Ward, grandfather, to Thos. Ward and Edw. Rogers to uses:- as to the tithes to Samuel Ward, grandfather, for live, then to uses in Indenture of 7 April 1815 of Tybrith and Llwynygo, and as to the over ½ and hereditaments to use of Samuel Ward, grandfather, for life, remainder to John Edmunds and heirs forever, and to hold the personal estate to Thos. Ward and Edw. Rogers on trusts for benefit after death of Samuel Ward, grandfather, as well of John Edmunds and Jane his wife and their children as also of Samuel Ward party and of his sister Ann Ward. Provided the provisions for Samuel Ward party were made in confidence hw ould not avoid, vacate or disturb the exchange made with Richard Croxon, but confirm same; otherwise the provisions for him to cease and tithes remain to John Edmunds. Samuel Ward, grandfather, died 11 April 1840 leaving Samuel Ward party then a minor but has since reached 21 and now willing to adopt the disposition made by Indenture of 20 Sept. 1833 of the other ½ of the 3 pieces received in exchange from Richard Croxon and of confirming the same etc.
Now Samuel Ward to assure to John Edmunds the remaining ½ of the 3 pieces and to ban estate bail of Samuel Ward party granted to John Edmunds and heirs the undivided ½ of Samuel Ward party in 2 pieces of land on Wern Issa, township of Lower Maesbrook, formerly allotted to Richard Croxon, and in the other piece of land called the Maesyfried in township of Tirycoed, which 3 pieces (now or late John Lloyd) and in other lands in deed poll of 10 May 1815 received in exchange from Richard Croxon. To John Edmunds and heirs to his use forever.
