Recitation of party of the settlement of 23 Nov 1770 (465/608) relating to the Manor of Edgeton and messuages & lands in Edgeton, Brunslow, Horderley, Woolston, Up Rossall, Weston Parva & Middleton limiting them to the use of Walker and Harries for 400 years, and granting an annuity to Elizabeth of £250 out of the rents of the premises if she survived her husband.
Whereas Humphrey Sandford has by Elizabeth 6 younger children, Edward, Elizabeth, Frances, Barbara, Susanna, and Charlotte.
Whereas a marriage is intended between the Rev George Holland, clerk and Frances Sandford, and H.S. having occasion for £400 towards her marriage portion, has borrowed the same from Mary Adney and has agreed that the aftermentioned premises shall be as a security for re-payment of the sum with interest; therefore in consideration of £400 from M.A., Thomas Harries by direction of H.S. has assigned the manor, messuages, lands & hereditaments comprised in the 400 years & all the estate, right & interest of Harries in the premises, to hold for 400 years from the day of this date in as full and beneficial a manner as Harries held it, subject to the condition that if H.S. or his assigns or the persons next after the decease of H.S. becoming entitled to the immediate freehold or inheritance of the premises pays to M.A. £400 with interest at 4½% by the year on the 29 September next, then M.A. will at the request and costs of H.S. or his successor vacate and surrender this deed and reconvey the premises during the residue of the 400 years in trust for H.S. or his successor; and Harries covenants with M.A. that he has not incumbered the premises; & H.S. covenants with M.A. that he will pay the £400 with interest on the time in the proviso & that Harries and H.S. or one of them has full power to demise the premises for 400 years, and she may after default has been made in repayment peacefully enter & possess the premises & take the rents & profits from them and T.H. & H.S. will at any time after default in the repayment at the request of M.A. at the cost of H.S. make further acts in the law for the better assuring of the premises to M.A.; and it is covenanted that until default is made in the performance of the proviso of redemption it shall be lawful for H.S. to enjoy the premises and receive the rents & profits without trouble from M.A.
