'The Vice Chancellor .... suggests that Mrs Fell adopt one of the following courses. Either to file a fresh Bill stating shortly the circumstances of the case, and that the Executor claims the property included in the settlement as belonging to the Estate of the Testator and asking to have it declared that the settlement is valid and that the property comprised in it belongs to herself and her four children, or that we should give Mrs Fell notice to attend the present proceedings and that she should do so and let the Chief Clerk by his certificate find that the settlement is invalid and that the property comprised in it forms part of the Testator's estate and then Mrs Fell could take exceptions to that finding in the certificate and have the matter argued in court'.
