Description

(i) Stephen Smith als Poynting of Street in par. of Pull als Pill, yeoman, and George Davis of South Brewham, yeoman, and wife Joan;

(ii) Thomas Colley of Babcary, yeoman; and

(iii) Edward Colley of Babcary, yeoman.

[Recites: (A) Lease for 99 years and lives, dated 13 Sep. 35 Car. II [1683]: Ralph, Lord Stawell, Sir John Austen, bart., Robert Austen, esq., and Edw. Austen, gent., to Stephen Smith als Poynting of Streete, yeoman, decd., father of sd. S. S. a. P.:

Mess. and 44. ac. in manor and par. of Babcary [as in No.DD/BC/112]; to hold to S. S. a. P. for term of 99 years if Thomas Rawlings, S. S. a. P. (the son, party hereto), and John Hayward son of John H. then the younger of Bagberry (co. Som.) yeoman, so long live; at yearly rent of 17s. 8d.

(B) Articles of Agreement, dated 27 Jan. 5 Wm. and Mary [1693/4], by which, in return for £250, S. S. a. P. senr. covenanted to assign the recited premises to Edw. Colley for the unexpired term.

(C) That S. S. a. P. senr. is now dead, and letter of admon. have been granted to sd. S. S. a. P. (party hereto) and the sd. Joan (wife of Geo. Davis party hereto).

(D) That S. S. a. P. senr. received £150 of the sd. purchase money before his decease, and that S. S. a. P. (party hereto) and Geo. Davis (in right of his wife) are each entitled to the moiety of the remaining £100 by virtue of the Admon.].

The sd. recited term on the property above described.

(To hold to (ii) for the remainder of the term in trust for (iii)).
