Description

Folios 715-716. Draft letter from the Local Government Board to Walter May Barton, Clerk to the Guardians of the Mitford and Launditch Poor Law Union, in reply to his letter of 8 December 1880, in which the draft conveyance from the Guardians of the Mitford and Launditch Poor Law Union to B J Woodhouse, of the property in the parish of Bawdeswell mentioned in the sale order dated 30 June 1880 was sent for approval. The Board return the draft conveyance, stating that the form of conveyance which has been adopted is hardly applicable to the peculiar circumstances of the case, having regard to the fact that the charge for £180 and interest was created by the deed which conveyed the property for the benefit of the parishes of Bawdeswell, Billingford, Bylaugh, Foxley and Sparham, and that therefore the interest of those parishes is subject and subsequent, to the interest of the persons entitled to that sum and interest [not included]. The Board considers that the person so entitled should be a party to the deed, and that, on receipt of the sum of £180 and interest out of the purchase money; he should release the property from any lien, which he may have to secure the sum. The balance of the purchase money, it appears, should be paid to the treasurer of the guardians: in respect of the interest of the parishes in the property, the guardians: then conveying such interest to the purchaser, leaving the subsequent destinations of the balance, if any, of the purchase money to be settled by an order of the Board. Should the guardians have any observations or remarks concerning this proposal the Board are willing to give them due consideration.
