(i) The Rev. Robert Samuel Battiscombe of Barkway (co. Hertford), clerk, the Rev. William Battiscombe of Islip (co. Oxford), clerk, the Rev. Henry Battiscombe of Cambridge, clerk, and the Rev. Charles Luxmoore of Eton College (co. Bucks.), clerk, and his wife Myra, (which sd. Robert Samuel, William, Henry, and Myra are the only surviving surviving children of Robert Battiscombe late of Windsor (co. Berks), esq., decd., and wife Susannah née Griffinhoofe);
(ii) The Rev. Richard Battiscombe of Hactons (co. Essex), clerk, and the sd. William Battiscombe (exors., of the Will of Benjamin Cook Griffinhoofe formerly of Lincolns Inn (co. Midx.), gent., and late of Kentish Town (co. Midx.), esq.; and
(iii) The sd. Richard Battiscombe, eld. son of Robert B. and wife Susannah.
[Recites: (A) Lease and Release, dated 5, 6 Aug. 1796: (i) the sd. Robert B.; (ii) the sd. Susannah Griffinhoofe; (iii) John Battiscombe and Joseph Goodall; and (iv) the sd. Benjamin Cooke Griffinhoofe and John Oxley Parker of Chelmsford (co. Essex), gent; on the intended marriage of Robert B. and Susannah G.
The manor of Hewish and properties therein [largely as described in Nos. DD/BC/90 and 86].
Limited to the use of (iv) for 400 years in trust for eld. son of the marriage and the heirs of his body, and on further trust to demise in order to raise £2000 for the portion of all other children of the marriage;
(B) That Robert Battiscombe died on [blank] Feb. 1839, and Susannah on 20 May 1844;
(C) That John Oxley Parker died leaving Benjamin Cooke Griffinhoofe as surviving trustee;
(D) That B. C. G. made Will dated 24 Oct. 1839 appointing Richard and William Battiscombe exors. thereof, died on 9 Feb. 1841, and Will proved P.C.C. 2 Mar. 1841;
(E) That Richard Battiscombe is the first son of the marriage and entitled to the inheritance of the sd. manor, etc., and is prepared to advance the sum of £2000 due to the younger children;
(F) That apart from Robert Samuel, William, Henry and Myra [as above] who are entitled to the sd. £2000, the only other child of Robert and Susannah was George Frederick Adolphus Battiscombe who died in Sep. 1836 in the lifetime of his father intestate, unmarried and under 21].
Parties (i) and (ii) above discharge Richard Battiscombe (party (iii)) and the manor of Hewish of all right vested in them, on payment of the £2000.
