The trustees under the marriage settlement of the Rev. William Hopkins and wife, to the surviving trustee under the marriage settlement of the Rev. Humphrey Sandford and wife.
Indenture made January 7th, 1822 between Thomas Tarleton the younger of Cloverley esq. and Rev. Edward Bather of Brace Meole clerk 1st part, Rev. William Hopkins of Fitz, and Jemima Hopkins (née Oliver) 2nd part, Folliot Sandford of Bath esq 3rd part, Rev. Humphrey Sandford of Shrewsbury, clerk, eldest son and heir apparent of Folliot Sandford and Frances his wife (née Holland) 4th part, Frances Holland of Shrewsbury widow, 5th part, Rev. William Sandford of Newport, clerk, 6th part, Jonathan Scott of Shrewsbury esq., 7th part, whereas by indenture May 5th 1812 between Foliot and Humphrey Sandford of 1st part, William and Jemima Hopkins 2nd part, Thomas Tarleton and Edward Bather 3rd part. Mortgage charges of £1600 and interest, and charge of £2000 for marriage portions of daughters of Humphrey Sandford deceased and Elizabeth his wife noted, on certain premises intended to be granted and demised, and also that by indentures of lease and release, November 14 and 15, 1804, between Foliot Sandford 1st part, Humphrey Sandford 2nd part, Richard Griffiths gent. of 3rd part, Robert Pemberton, gent. 4th part, Jonathan Scott and Rev. George Holland 5th part, and by common recovery in which Foliot and Humphrey Sandford were voucher and vouchee, all manors etc. intended to be granted, settled to several uses, trusts, and intents to be declared. 1 for establishing several powers given in indenture of release Nov. 23rd, 1770 to Foliot Sandford of jointuring making provision for wife and raising portions for children, concerning messuage with appurtenances at Edgton, then in occupation of Christopher Wilkes, 180 ac. 2nd, 39 pr. yearly rent £140, to the use of Humphrey Sandford and heirs, subject to proviso mentioned; all other manors, messuages etc. intended to be released to the use of Folliot Sandford for natural life, remainder to use of Jonathan Scott and George Holland for 1000 yrs. from day of decease of Folliot Sandford, in trust for raising £2500 for additional portions for daughters and younger sons of Folliot Sandford, Remainder to the use of Humphrey Sandford and heirs. By indentures of release and settlement Nov. 23rd, 1804 provided that Humphrey Sandford should demise messuage in occupation of Christopher Wilkes to Folliot Sandford and heirs for 99 years, yearly rent £150, proviso enabling Foliot Sandford to grant to Isabella, wife, or children any annual sum not exceeding £50. Agreement January 19th 1811 between Humphrey Sandford 1st part. Frances Holland of the 2nd part Frances Sandford (nee Hotland) of 3rd part Jonathan Scott and Robert Pemberton 4th part, Frances Southern gent. and Rev. William Henry Parry, clerk 5th part, in consideration of marriage to be celebrated between Humphrey Sandford and Frances Holland, covenant that Humphrey Sandford when Frances Holland should reach 21 years, should grant to Jonathan Scott and Robert Pemberton the messuage in occupation of Christopher Wilkes, and held by Folliot Sandford, to hold by Jonathan Scott and Robert Pemberton for 40 years, from the death of Humphrey Sandford, upon trust to permit Frances Holland to receive rents for life, if Folliot so Long live By same indenture that Humphrey Sandford should demise to Jonathan Scott and Robert Pemberton all manors and estates of Edgton and Up Rossall with messuages, lands etc, belonging, to hold by Jonathan Scott and Robert Pemberton for 99 yrs. from death of Humphrey Sandford, in case Folliot be then deceased, otherwise on his death to the intent that Frances Holland daughter to receive annuity or clear rent charge of £550 during her life for her jointure and in lieu of dower. Also that Humphrey Sandford (subject to annuity) to demise to Francis Southern and William Henry Parry all said manor and premises, for 2000 yrs. from death of survivor of Folliot and Humphrey Sandford, upon trust to raise £4000 for portions for daughters and younger sons. Reciting that by indenture January 23rd 1810 between William Hopkins 1st part, Rev. William Hopkins the elder of Fitz, clerk, William Prissick of Shrewsbury esq. and Jemima Hopkins, then Oliver, spinster, 2nd part, Thomas Tarleton and Edward Bather of 3rd part, settlement in consideration of a marriage to be celebrated between Jemima Oliver and William Hopkins, all real estate of Jemima Oliver convenanted to be conveyed to Thomas Tarleton and Edward Bather, in trust to sell and dispose of same to invest money obtained from same on government or real securities, for the benefit of William Hopkins, Jemima his wife, and children. Further reciting that the premises have been sold, and money received by Thomas Tarleton and Edward Bather. Indenture further witnesses that in consideration of £3000 (part of Trust money) paid by Thomas Tarleton and Edward Bather to Folliot and Humphrey Sandford at direction of William Hopkins and Jemima his wife, grant and demise to Edward Bather and Thomas Tarleton of all manors of Up Rossall and Edgton, and the capital messuage in Up Rossall, 75. 1r. 33 pc. messuage and farm belonging called The Isle Farm, in occupation of Edward Gittins then of Simon Hales, 210a 3r 15p the Isle Park farm, late in the occupation of Edward Gittins, then of Stephen Matthews, 228a. 25pc.; messuage called the Isle Gate farm, in occupation of Thomas Mansell, 66 ac. 13 pcs.; messuage in occupation of Martin Luther, 202ac. 12pr.; messuage called Ridgeway tenement, in occupation of same 20a. 1rd. 15pr. messuage of Charles Sandford then of Christopher Wilkes, 180 ac. 2rds. 39 pcs., also 4 messuages in occupation of Mrs. Mary Sandford Christopher Wilkes, Martin Luther, which last messuages are in the townships of Edgton, Brunslow, Horderley, and Wolston, and all chief and other rents from estates in townships of Edgton, Brunslow, Horderley, and Wolston, 28s. 3d. altogether, with all houses, outhouses, edifices, dovehouses etc. pertaining to manors, messuages, etc. intended to be conveyed. To hold by Thomas Tarleton and Edward Bather for 3000 yrs. from date of present indenture, proviso of redemption on repayment of £3000 by Humphrey Sandford, and interest. Whereas by indenture February 8th 1815 between Humphrey Sandford and William Coupland of Shrewsbury (see copy of indenture 465/190). Whereas by indenture of release December 2nd 1813, to be made between Humphrey Sandford and Frances his wife 1st part, Frances Holland 2nd part, William Coupland 3rd part, Jonathan Scott and Robert Pemberton of Shrewsbury 4th part, Francis Southern of Lydbury North, and Rev. William Henry Parry of St. John's College Cambridge, of 5th part, settlement subsequent to the marriage of Humphrey Sandford and Frances Holland, assignment by Humphrey Sandford and Frances his wife, according to articles of the agreement, to Jonathan Scott and Edward Pemberton sums of £7266 16s. and £1074 15s. 10d. capital stock in 3% consolidated bank annuities, also legacy of £500 from will of Edward Sandford esq. To hold by Jonathan Scott and Robert Pemberton upon trust that Jonathan Scott and Robert Pemberton with authority of Humphrey and Frances Sandford to re-invest capital sums upon real or government securities. Whereas Thomas Tarleton and Edward Bather lately requested Folliot and Humphrey Sandford for repayment of £3000 (arrear of interest already satisfied), advance by Jonathan Scott to Humphrey Sandford of £3000 out of trust money. Indenture witnesses that in pursuance of agreement, and in consideration of £3000 paid by Jonathan Scott to William Hopkins and by William Hopkins to Thomas Tarleton and Edward Bather, at the request of Folliot Sandford, Humphrey and Frances Sandford, and Frances Holland. bargain and sale of premises, with consent of all parties, to William Sandford, to hold for 3000 yrs. the manors, messuages, chapelries, glebe, lands and tithes, discharged from provisos for redemption contained in several previous indentures of mortgage. Statement by Thomas Tarleton, Edward Bather and William Hopkins that they have not at any times incumbered premises with any charges or costs. Agreement that Folliot and Humphrey Sandford shall pay to Jonathan Scott principal sum of £3000 and interest. That it shall be lawful for William Sandford to enter premises released to him by Humphrey and Folliot Sandford, without disturbance by either of them. Agreed between William Sandford and Jonathan Scott one part, and Folliot and Humphrey Sandford the other, that until default in payment of £3000 made it shall be lawful for the persons for the time being to occupy and enjoy the messuage, farms manors, etc. without any interruption whatsoever., by either William Sandford or Jonathan Scott.
