Sir Thomas Whitmore late of Bridgnorth knt. of the Bath who died intestate 28 June 1680 entered into a recognizance in the nature of a statute staple of £600 penalty to --- and Robert Baker gent conditional on payment of £309 on 29 Dec. following. Whitmore died greatly in debt. Ann Rowbert widow now decd. a judgment creditor for a debt of £800 in time before the recognizance, took out letters of admin. to the said Sir Thomas Whitmore as (principal) creditor. She and others being called to account by Richard and Robert Baker and Hester Founes widow another principal creditor upon a like recognizance for £600 who in Hilary term 1684/5 exhibited their bill in chancery against Ann Rowbert and others debts. The cause was heard 2 James and a decree -- to go to one account. Ann Rowbert's pretentions are much more than Whitmore's real and personal estate and all that since can be found is only a freehold house at Bridgnorth of the yearly value of £17 as it is now rented nor will any body give more for the same, and there are many encumbrances charged on this property before Baker's recognizance. William Milman was attorney and solicitor formerly employed in the suit and he laid out in law and in chancery £70 of which £40 has been paid by Richard and Robert Baker and the remainder is unpaid. The whole debt and interest on the recognizance is still unpaid and above £500 is still due to Ann Rowbert's executors.
19 July last Robert and Richard Baker by deed poll assigned their right to Milmas so that he could act for them and he agreed with Lancellott Taylor, attorney at law who is concerned for several his clients in their claims against Whitmore's estate.
Cons: £180 to be paid to Milman by Taylor.
Assignment of this power to Taylor, provided that if the Bakers do not approve within one month, Milman shall pay back the money and Taylor reassign, notice to be left for Taylor at the sign of the Wheelbarrow in Crooked Lane, London. In the meantime Taylor shall keep harmless Milman from all costs relating to the matters assigned.
