(a) John Leggatt and John Battcock, both as in Add Mss1128
(b) Richard Dally of Chichester, gent., and William Raper of the same, merchant (two of the creditors of said John Leggatt and trustees nominated for the purposes hereinafter), (c) the other creditors of said John Leggatt executing this deed within the time hereinafter limited
I. Property, as in Add Mss1128
II. Messuage, slaughterhouse, stables, buildings, yard and garden in the West Lane otherwise called the Upper West Lane, Chichester, between the messuage and garden formerly of John Slade since of Edward Hardham and now of Joseph Hardham on S., the messuage, garden, stable and slaughterhouse formerly of Henry Cranborne since of William Knott and late of Joseph Pritchard on N., and the Upper West Lane on E., and which messuage, etc., was purchased by Joseph Leggatt, decd., father of said John Leggatt, of Sarah Baxter, and has been since conveyed by the devisees in trust and legatees named in the will of said Joseph Leggatt to said John Leggatt, and said John Battcock as his trustee, and was formerly in the tenure or occupation of the widow Nash and others, afterwards of Maurice Phillips, since of Daniel Wittman, John Leggatt, Robert Heath and Thomas Dennett, late of said Joseph Leggatt, and now of said John Leggatt
III. Property, as in II in Add Mss1133
IV. See the cattle and other live and dead stock, household goods and all the other personal estate of said John Leggatt on the above properties (his wearing apparel and that of his wife excepted), and all debts owing to him
Conveyance of the properties in I and II, being freehold, from said John Leggatt, with the approbation and consent of (c), and from said John Battcock, at the request and by direction of said John Leggatt, to (b), and assignment of the property in III, being leasehold, and of the personal estate in IV, from said John Leggatt, with the approbation and consent of (c), to (b), upon trust to sell all the above, and after the payment of the mortgages on the real estate and the payment of necessary expenses, to divide the money among themselves and such of the other creditors as should sign this deed within eighteen months, in equal proportions
Schedule of debts owing by said John Leggatt
Recites: (i) that said John Leggatt, and said John Battcock as his trustee, are entitled to the equity of redemption in the property in I, lately purchased, as in Add Mss1129, and which property is subject to a mortgage for £1,000, as in Add Mss1130, and, with the property in III, to a mortgage for £600, as in Add Mss1133, and are also entitled to the equity of redemption in the property in II, which property is subject to a mortgage by demise thereof, 17 Aug. 1803, to secure £200, from (a) to William Dawes of Chichester, ironmonger; (ii) that said John Leggatt is entitled to the equity of redemption in the property in III, as in Add Mss1133; (iii) that said John Leggatt is possessed of the personal estate, as in IV; (iv) that said John Leggatt is indebted to said Richard Dally in the principal sum of £130 for money lent to him on note of hand, and to said William Raper in the sum of £15, and to other persons as in the above schedule; (v) that said John Leggatt, being unable to satisfy the said demands on him, has proposed to convey and assign his real and personal estate to (b) upon the trusts as above, to which proposal (c) have assented
