Probate of the Will of Thomas Winter of Penrith, mercer, - long, devout preamble; son Thomas (a minor); wife (of testator) Mary; estate Ellerbeck and The Raw; seal "T.W."; original Will, dated 27 May 1687. Proved at Penrith, 1689
Marriage settlement of Thomas Winter of Kendal, "Iron Munger", and Ann, the eldest daughter of Lancelot Forth Esq., the present Mayor of Kendal; settled prior to marriage, upon Hugh Simpson of Penrith gent., Thomas Rowlandson of Kendal mercer, and John Mounsey of Patterdale gent., as Trustees) - the house and land at Ellerbeck, with all .. tofts ..; settled by Lease and Release, 1708

Copy of Verdict of the Manor Jury of Barton - that Ellerbeck was farmed by the father of William Mounsey (now living), from "one Mr Winter" for 21 years; that it is now owned by Mr Thomas Mark; that Mr Winter allowed his (William's) father 5s. 0d. a year "for throwing loose stones out of the Ake Beck and Eller Beck", and that since that term's end "many bushes have grown up in Ake Beck to obstruct the ancient course of water"; some of the family went below Akebeck Bridge and "threw stones out of that part" also, though William cannot say whether they "sho[ul]d" have; - the Verdict is, "that Edward Hasell Esq. and Mr Thomas Mark should cleanse and keep open the Watercourse that divides the Grounds equally between them", 1777 (copy c. 1777)
"Mr Mark's Bidding Paper for Letting Ellerbeck" - being the letting particulars with bidders' signed bids and the highest bidder's agreement to take the premises, let on 1778 at the "Sun", Pooley.
Comprised the Raw (occ. Mr William Armstrong) and "Allerbeck" (occ. Mr Thomas Mark), excepting the Mansion House called Ellerbeck, Little House, pigsty adjoining, the New Stable and hayloft over, "The Kill" [Kiln], the field at front of the Mansion House; right of way over this last for the farmer going to his barn, but he shall remove all droppings etc. thereby; also to let, 5 cattlegates in Martindale Forest; the farmer "must live at Raw" and not keep any kind of poultry at Ellerbeck; the landlord may keep up to 20 hens, 1 cock, 12 ducks, turkeys, pigeons, etc., at Ellerbeck, at his will; husbandry clauses; timber clause; repairs clause; landlord reserves a road through the wood to the Common, and right to fell timber; hedging clause; the bids; let to John Wilson for £114. 13 bids from 5 bidders.
