Description

Whereby, having recited: firstly, the 24th. Aug., 1827 mortgage (by Edward Reynolds and Benjamin Ginn for 1,000 years) to Thomas Wingfield (with John Carter and William Prime participating), for £500 paid to each mortgagor, premises hereinafter firstly- and secondly- described (together with a piece of land since sold by the late Honora Mattocks with Thomas Ginn (in 1844 described as of Hertford, plumber) and Henry Guy (in 1844 described as of Hamsey Place, Suss., gent.) to Thomas Harris (of Coventry, merchant)); secondly, T. Wingfield's 20th. Mar., 1841 assignment (for £1,000) to John Molesworth (of Coventry, ribbonmanufacturer) of the premises for the rest of the term; thirdly, Edward Reynolds' having been interested in a moiety of all the premises hereinafter described, with a recital of his will; fourthly, that B. Ginn (interested in the other moiety) by his 16th. June, 1831 will bequeathed his Coventry hereditaments to his brother by law Thomas, Honora Mattocks and Richard Dewes (of Coventry, gent.) upon trust for sale; fifthly, that B. Ginn's 3rd. Dec., 1834 codicil was irrelevant to this deed but that dated 23rd. Feb., 1835 replaced R. Dewes as trustee by Thomas Ginn and H. Guy; sixthly, B. Ginn's death, and the proof of his will on 14th. Apr., 1835; seventhly, that J. Molesworth is only owed £500 principal; eightly, that on 15th. Jan. [, 1844] T. Ginn and Guy agreed to transfer their moiety to H. Mattocks (subject to repayment of the £500 due from B. Ginn's estate to Molesworth) for £550; ninthly, that H. Mattocks has since died, making her sons Edward and Thomas (in this deed described as of Coventry, gents.) her executors and sole beneficiaries according to her 27th. Jan., 1835 will; and tenthly, that the younger Mattockses are ready to honour their mother's agreement: therefore, in consideration of £550 and discharge of the £500 mortgage, T. Ginn and Guy sell to E. and T. Mattocks a moiety of (a) two messuages with gardens (formerly an orchard) in Ram Bridge or Smithford St. (built by Reynolds and B. Ginn on the site of one house and its ground which with other premises had been the property of James Birch (silkman), John Kirkman (Coventry alderman), John Kirkman (London alderman), Joseph Holmes & Co., Joseph Gibbons and John Ryley (watchmaker)), a warehouse, billiard-room and stables (built there by Reynolds and B. Ginn), the whole being now occupied by John Dell and Col. Ewart (bounded north by Smithford St., east by premises which used to be Nathaniel Lowe's but now belong to Mr. John Davis' devisees and run in a straight line north-south, south by the land sold to Thomas Harris, and west by the Sherbourne and (c)'s messuage); (b) 586 sq.yd. used as a garden and adjoining (a) in St. John Baptist's pa. (part of "Little Poddy Croft") lately occupied by H. Mattocks but now by her sons (bounded north by John Davis' devisees' premises, west and south by Henry [I] Butterworth's gardens, and east by the land sold to Harris); and (c) a messuage built by Reynolds and B. Ginn on Ram Bridge (bounded north or north-east by Fleet St., west or north-west by H. [I] Butterworth's estate, south or south-west by the Sherbourne, and east or south-east by (a); lately occupied by Henry Bannister but now by Charles Hansom): Harris will pay one-quarter of the road-maintenance, the walls dividing Harris' property from the gardens belonging to J. Dell, Ewart and the Mattockses will be maintained equally by Harris and the Mattockses as T. Ginn, Guy and H. Mattocks built them (as they were shown on the 1844 agreement's plan); (a) and (b) remain subject to Molesworth's mortgage until its discharge.
