Description

Mortgage: Joseph Musgrave of Richmond, Surrey, esq., executor of Sir Chris. Musgrave, late of Edenhall, co. Cumberland, bart., deceased, of the first part, Vigerus Edwards of the Inner Temple, London, esq., of the second part, Samuel Barker of Lyndon, co. Rutland, esq., devises for life to his issue male in tail of lands mentioned below of Sir Thomas Barker, bart., deceased, of the third part, and John Whiston of London, bookseller, of the fourth part: recites a deed dated 12th December 1691 whereby for the sum of £1500 said Sir Thomas Barker mortgaged to James Buck, of the Middle Temple, London, esq., several closes in LYNDEN alias LYNDON, to hold for 500 years at pepper corn rent redeemable for £1575, which by deed dated 8th May 1694 said James Buck, for £1500, assigned to Sir Chris. Musgrave on similar terms, and by deed poll dated 9th May 1735 said Joseph Musgrave, for £500 paid by Vigerus Edwards, agreed to stand possessed of a third part of the mortgaged premises in trust for said Vigerus subject to redemption with interest, and to accept interest at 4% on the remaining £1000: whereas all interest for the two principal sums of £500 and £1000 have been paid but the principal sums remain due on the mortgage, and in order to secure the payment of the £500 unto said Vigerus with interest until the principal should be paid, said Joseph Musgrave assigns unto Vigerus the third part of the mortgaged premises for the residue of the term of 500 years, and in consideration of the sum of £1000 assigns unto said John Whiston the remaining two thirds of the mortgaged premises for the remainder of term of 500 years, subject to agreement concerning redemption.
