Description

1. William Wrighte of Penn co Bucks esq. and Sarah his wife, late Sarah Stanier widow and relict of Richard Stanier heretofore of Pepperhill co Salop esq. deceased

Recital of a settlement dated 10 December 1736 previous to the marriage of Richard Stanier with Sarah, then Sarah Bach, giving her a life interest in the property (S.R.O 924/66)

Consideration: docking all estates tail, and 10s to Wrighte and his wife

Lease and release of the manor or reputed manor of Cosford otherwise Gosford co Salop the manor house in the parish of Albrighton called Cosford Grange (Bartholomew Martin and Giles Martin, afterwards Edward Martin, now or late Orlando Stubbs) and lands in the townships or parishes of Cosford alias Gosford. Albrighton and Donnington; water corn mill and lands (John Wheeler); mansion called Hatton House in the parish of Brewood co Staffs (Thomas Plimley, formerly John Wade, now or late James Giffard) and all property of Wrighte and his wife or John Stanier in the townships or parishes or Cosford alias Gosford, Albrighton and Donnington; to make John Roberts tenant of the freehold for the purpose of suffering two recoveries. Wrighte and his wife covenant to levy a fine next Hilary term, the fine to enure to use of Roberts to the intent that he may be a good tenant for the recoveries to be suffered to the use of Sarah Wrighte and her assigns for her life, with power to fell and sell for her own use all or any of the coppices or underwoods at such times as they are usually cut by the custom of the country in which the same are situate and with power of leasing; after her death, to use of John Stanier his heirs and assigns for ever, but subject to the following proviso, that Sarah during her life either alone or jointly with William Wrighte her husband may demise any part of the property for any term not exceeding 21 years but not in reversion, the best and most improved yearly rents to be reserved without any fine or premium or foregift, no demise to be valid if it permits the tenant to commit waste unpunished, or if the tenant does not execute a counterpart; John Stanier may at any time cut down and sell any timber trees standing (but not coppice or underwoods) for his own use, paying reasonable compensation for damage as ascertained by two indifferent persons; with the consent of the Wrightes or of Sarah alone if she survive her husband, John Stanier may sell any part of the property for the best price to be got, the Wrights to join in the sale, provided that the money so raised is invested in the names of two trustees (one chosen by the Wrightes and one by Stanier) subject to these trusts - to pay during Sarah's life so much of the interest as shall be equal to her present clear annual income to her for her own use and divide the residue if any into two moieties, one to be paid to Sarah for her life for her own use and the other to John Stanier for his own use; after Sarah's death on trust to transfer the whole capital to John Stanier his executors, administrators or assigns for his use. If the annual rents from the property shall ever exceed the present income, then the surplus shall be divided into two moieties and paid as above. The trustees may reimburse themselves for expenses. If any sale is made before 25 March 1775 (by which time it is computed that the coppices or underwoods now growing will be cut or fit to be cut) and if Sarah is then living, their value at a fair appraisal shall be paid to her out of the purchase money for her own use.

If the property is sold and the interest on the investments is more than the present income, the trustees may, with Sarah's written consent, transfer to John Stanier the capital from which his moiety of the extra income derives.
