For £17,200 from; Arthur Edward Whieldon of Sweeney Hall, Oswestry, Salop, esq. and James Darlington of Meriden Hall, Warws, esq, George of Wyke Hall Dorset, esq to Alfred Hewlett of The Grange Chorley Lancs Esq, Arthur Edward Whieldon and James Darlington of (1) The Hawkesbury Colliery with coal and ironstone works, rents and roadways under Bedworth, Foleshill and Exhall. (2) The colliery managers house 'Springfield House', with the mines under it (3) Bedworth Hall, with gardens cottages and a tavern (4) The White Lion Inn with a malt house, four houses known as Bedworth Row, seven cottages in Pooles Buildings (5) Garden land in Hot Lane Bedworth, the mining rights being sold to Thomas Ball Troughton (6) Five pieces of land excluding mining rights by Springfield House (7) The former police station adjoining the Coventry to Nuneaton Turnpike. (8) Four pieces of land by the Coventry to Nuneaton Turnpike adjoining the Hawkesbury Hall Estate and a cottage to the West of the Oxford Canal and mining rights. (9) Surface of the land in Exhall excepting colliery works, fire clay works etc. Surface of the land in Foleshill. Where the owners of the land control mineral rights they are liable to compensation. Certain land is covenanted to be restored to its original condition after use.
The above recited list of property conveyed in this deed, is contained in the first schedule. The second schedule contains the deeds to the property including PA 171/18/4. The third schedule, the map of the properties being conveyed in this deed has been lost.
The context of this conveyance is as follows. George Whieldon in his will dated 9 March 1857 appointed Edward Arthur Whieldon, James Darlington and David Hastings Sands (now deceased) as executors. The testator left all his estate to be held in common amongst his surviving children, except his eldest son, who was to receive his share separately. The testator died in September 1858. His children at the time of his death were George Whieldon, the younger, and Arthur Edward Whieldon (now deceased), Katherine Mary Whieldon (now deceased), Georgina Elizabeth Sands (wife of David Hastings Sands, who is now deceased). By a decree of the Master of the Rolls of the 19 March 1860 in respect of the suits of (1) J. Omaney McCarrgher and others v Arthur Edward Whieldon and others (2) George Whieldon v J. Omaney McCarrogher and others, enquiry into the estates of the testator, including the property conveyed in this deed and by an order of the Master of the Rolls of 12 June 1863; the executors were to pay the cost of the cases by the sale of the estates of the restator. The property in schedule 1 was to be sold in 10 lots, lots 6 and 7 being sold in August 1867.
The remaining lots were to be conveyed to David Hastings Sands as trustee to Arthur Edward Whieldon, James Darlington and George Whieldon the younger for £30,400. The purchasers were to pay £5,000 to the Attorney General by the 2nd June 1865. George Whieldon, the younger, was to keep £6,000 of the purchase money as his share of his fathers estate. £6,000 was to be retained by George Whieldon, the younger, and Arthur Edward Whieldon until an order was made by the court in respect of the above cases, subject to the approval of Chancery.
The purchasers paid £5,004.0s.2d towards the cost of the cases by 1 November 1864 and £13,664 thereafter. By order of court 25 January 1867 George Whieldon, the younger, and Arthur Edward Whieldon were allowed to keep their shares of their fathers estate at a 5% annuity. The remainder of the purchase price of £33,964.14s.8d with a 3% annuity was paid towards the cost of the cases. The proceeds of the testators estate at Mitchett, Gloucs, was valued at £6,688.9s.8d including 3% annuities and was divided between George Whieldon, Harry Thomas Turner Whieldon and Georgina Elizabeth Sands.
The purchase money was raised as follows; £13,200 by James Darlington; £17,200 from Arthur Edward Whileldon and George Whieldon and £264.17s.6d as interest from the £13,400 paid as costs of the cases. The remainder of the purchase money was raised by the above parties as co partners. When David Hastings Sands died 4 February 1867, since no part of the above estate had been conveyed, the parternship was dissolved. George Whieldon agreed to sell his shares to Arthur Edward Whieldon and James Darlington and in respect of this, the above property is to be conveyed to Alfred Howelett for £1,250 and for £17,200 of the purchase price of £33,400 as trustee to the use of James Darlington and Arthur Edward Whieldon.
