Recital of Lease & release of 14 & 15 November 1804, the release between Folliot Sandford (1) Humphrey Sandford (2) Richard Griffiths, gent (3) Robert Pemberton, Esq (4) Jonathan Scott, Esq & the Rev George Holland, decd (5); & by virtue of a common Recovery in pursuance of the indres The Manors or Lordships, capital & other messuages, farms, lands, tenements, rents & hereditaments there described (& among others the messuage, lands & hereditaments hereinafter mentioned) & the reversion, remainder & rents subject to the incumbrances & charges therein mentioned, to the following uses: to the use of Folliot for life; Remainder to the use of Scott & Holland for 1000 years from the death of Folliot upon trust for raising £2500 for the portions of the children of Folliot (except Humphrey Sandford) remainder to the use of Humphrey for ever. Folliott lately agreed with Susanna for the absolute sale to her of an annuity of £50 to be paid to her during her life for £400 to be secured to her as hereinafter mentioned and Humphrey has agreed to join in making this security on being indemnified.
Now in consideration of £400 to Folliot, he & Humphrey grant to Susanna & her assigns the annuity of £50 to be paid during her life, chargeable on the messuage with the farm lands hereditaments & appurtenances called the Isle Farm in Up Rossall alias the Isle of Up Rossall in the Parish of St. Chad, late in the occupation of Edward Gittins and now of Francis France, of 210 acres 3 roods 15 perches, and out of all the outhouses & lands belonging, with all privileges, reversion remainder & rents; to hold the annuity to be paid by 2 equal half yearly payments on 13 May & 13 November without any deductions for taxes etc., the 1st payment on 13 November next, and if Susanna dies on any other day than one of the days of payment a proportionable part of the annuity to be paid to her executors for the time which has elapsed between the last of the days of payment before the death of Susanna and her death; and Folliot & Humphrey grant & covenant with Susanna that if the annuity is in arrears for 21 days then Susanna may distrain & sell the distress; and in case the annuity is unpaid for 31 days then Susanna her executors, administrators and assigns may enter and hold all the hereditaments charged with the payment of the annuity to receive the rents thereof until the arrears are paid; and for more effectually securing the annuity & in consideration of 10/- to Folliot & Humphrey from Wm Coupland, F. & H. at the request of & by the direction of Susanna, have demised to Coupland the messuage & lands called the Isle Farm charged with the payment of the annuity, for 100 years on trust that he will permit
Folliott during his life, and afterwards Humphrey, to take the rents & profits of the premises until the annuity of £50 is paid;if it is in arrears & unpaid by the space of 40 days, then they shall out of the rents and profits of the premises or by leasing, mortgaging or selling the premises for all or any part of the said term or by bringing any action against the tenant for recovering the rents & profits, or by any other way raise such sum of money as will be sufficient for paying Susanna the annuity of any part of it in arrears and all other costs & expenses which Susanna or Coupland sustain, & any surplus money to go to F. & H. for their own use; and Folliott agrees with Susanna that he will truly pay to her during her life the annuity, without deductions, at the proper times; and he also agrees with Susanna & Coupland that he & Humphrey or one of them has full power to grant the annuity, and to grant the premises for 100 years; and that the premises shall remain charged with the annuity during Susanna's life, occupied by Coupland free of any further encumbrances; and F. & H. will at the request of Susanna at their cost make further assurances in the law for more effectually charging the premises with the annuity, & granting the premises to Coupland; & Folliott agrees with Humphrey that in case H., his heirs, executors, administrators or assigns shall after the death of Folliot and through the neglect or default of the executors or administrators of Folliot pay any one or more of the annual payments to Susanna, then the executors or administrators of Folliot shall immediately repay to Humphrey all such sum as he has paid & all costs he has sustained by the non-payment.
