[Recites: (A) Leases dated 4 Apr. 36 Car. II [1684] and 7 Mar. 1 Jac. II [1684/5] by Ralph, Lord Stowell (with his Trustees Sir John Austen, bart., Robt. Austen and Edw. Austen, esqres.) to the sd. Robt. Clarke:
The property described below (except the cottage and yard); to hold to R. C. for terms of 99 years and 99 years determinable on the deaths of himself, wife Eliz. since decd., and James Clarke, son of William C. of Lovington, husbandman.
(B) That John, Lord Stawell, son of Ralph, Lord Stawell, created terms of 2000 years and 3000 years in
The manor of Babcary of which the property described below is parcel;
(C) That Indenture dated 20 Aug. 12 Wm. III [1700] made between Robt. Clarke and Joseph Guppy, the terms of 99 years and 99 years were assigned to J. G. in trust to wait the inheritance of the property described below (purchased by R. C. from Francis Bennett, gent. and granted as shown in Lease and Release, dated 25, 26 Aug. 12 Wm. III [1700]).
(D) Assignment of the terms of 2000 years and 3000 years dated 26 Aug. 12 Wm. III [1700]: (i) Frances Sherwood of Somerton, widow and execx. of Ralph S., gent.; (ii) Robert Clarke; and (iii) Jonathan Colmer; to hold to (iii) in trust to wait upon the reversion and inheritance.
(E) Demise for 1000 years, of even date with this Indenture [No. DD/BC/128]]
Dw. house, etc. cont. 1 yd., formerly in ten. of John Lang, decd. (not conveyed in either of the sd. recited Leases for 99 years); and a close of mdw. called the Farmers Moore (25 ac.), and close of past. called Breach (16 ac.), formerly parcel of Rawleighs Farm formerly in possn. of Andrew Overton, gent., decd. All in the manor and par, of Babcary and formerly parcel of the manor, and now in possn. of Robert Clarke.
(To hold to Wm. Ruddock and Edw. Weare during the residue of the terms of 99 years, 99 years, 2000 years and 3000 years, in trust for the uses etc. declared in the demise of even date [No. DD/BC/128].
