Description

Lease and release - conveyance

There is now due to Powell Bemand £1000.

Samuel Groves late of Priest Weston, decd. made his will 21 Nov. 1828 (2873/12). He died on 8 Oct. 1829 and Margaret his widow died on 15 Feb. 1821. Robert Groves, Sarah the wife of Thomas Gough, Mary wife of Samuel Groves and Margaret wife of George Harris are still living and each has several children living and their legacies are still charged on the house and farm at Priest Weston and are not yet payable out of it.

William Groves late of Wotherton, gent, now decd., made his will on 20 June 1838 (2873/13). He died 22 Nov. 1838 and his will was proved 18 Feb. 1840, P.C.C.

Whereas Sir Offley Penbury Wakeman has contracted with Robert Groves and Samuel Groves for the purchase of the houses and lands below for £3,000 out of which it has been agreed the £1000 shall be paid to Powell Bemand in discharge of the mortgage, and the residue of the term of 700 yrs shall be assigned to Edward Wakeman in trust to attend the inheritance of the same, and that the legacy of £100 to Robert Groves be paid off, and the remaining £350 shall remain charged on the premises to be paid by Sir O.P. Wakeman in discharge of the other three legacies when payable and the interest of it in the meantime to be paid according to the will of Samuel Groves.

Therefore in consideration of £1,000 to Powell Bemand who assigns to Edward Wakeman the house and farm with lands belonging (106a) in Great Weston alias Priest Weston in the parish of Chirbury (heretofore Arthur Williams, since of Samuel Groves and the said William Groves, now or late of Robert Groves and Samuel Groves, party); and the house and lands in Little Weston alias Great Weston, parish of Chirbury, (heretofore John Jones, since of Samuel Groves and now or late of John Peever) which premises were assigned to P. Bemand by indenture of 1 Nov. 1825. To Edward Wakeman for the rest of 700 years in trust for Sir O.P. Wakeman to wait upon the freehold, reversion and inheritance.

And in consideration of £1,550 to Robert and Samuel Groves, and £100 to Robert Groves in discharge of the legacy by the will of Samuel Groves, they convey to Sir O.P. Wakeman:-

The house and farm with lands (106a) in Great Weston alias Priest Weston, Chirbury (heretofore Arthur Williams, then Sam. Groves and Wm Groves, now or late Robert & Sam. Groves, party);

The messuage and lands in Little Weston alias Great Weston, Chirbury (heretofore John Jones, since Sam. Groves, now or late John Peever); the piece of arable (3a) in Priest Weston called the Kinwoods (Robt Groves and Sam. Groves) - see particulars in schedule at bottom, from a recent survey. To hold to Sir O.P. Wakeman and his heirs forever, subject to and charged with sums of £100 for the benefit of Sarah Gough and her children; of £100 for Mary Groves and her children, and of £150 for Margaret Harris and her children as in the will of Sam. Groves, decd.
