Recitation of the further mortgage of 1st August 1745 (465/322)
Whereas by lease and release of 30th and 31st July 1746 between Timothy Seymour (1), John Ingram (2), T.S. granted to Ingram the mortgaged premises subject to a proviso for redemption on payment of £355 and interest, which sum has not been paid according to the proviso whereby the estate has become absolute in law to Ingram; and whereas there is owing to Margaret Lee on mortgage £3,156 and Stanier has agreed with T.S. For the purchase of the inheritance of the premises for £3,150; therefore in consideration of this sum from Stanier to Margaret Lee, Ingram at the desire of T.S. grants, and T.S. confirms to Stanier the capital messuage with the appurtenances in Up Rossall now in the tenure of Edward Edwards, the other messuage and the pond called the Isle Poole in Up Rossall now or late in the tenure of T.S., and all T.S.'s other property in Up Rossall and all deeds belonging; to hold to Stanier his heirs and assigns for ever; and T.S. covenants that he or Ingram is the lawful owner of the property and have full power to convey it, and T.S. may hold it peacefully free of all incumbrances; and T.S. agrees with Stanier at the request and cost of Stanier to make a further assurance in the law for conveying the premises to Stanier.
Ingram covenants that he has done nothing to incumber the premises.
