Recitation of the Marriage Settlement of 29 April 1790 (465/617, 465/618)
And whereas since the execution of the settlement it has been agreed on between Sandford & Holland that G.H. shall covenant to grant to certain trustees the hereditaments hereinafter mentioned for a term of years to raise £1,000 for the benefit of the younger children of the marriage; Therefore it is agreed that G.H. will within 6 months after the marriage grant & demise to 2 or more trustees to be nominated by G.H. & approved by H.S. the piece of meadow called great Humball of 5 acres; and the piece of meadow called Catsbrain of 5 acres, which 2 pieces of ground are now in the occupation of William Jefferies as tenant thereof at the annual rent of £21; and 2 pieces of arable land facing the village of Burford and called the two pieces facing Burford of 9 acres now in the possession of George Ridley jnr. at the annual rent of £10; and the piece of meadow called little Humball of 6 acres now in the possession of William Johnson at the annual rent of £11; and the piece of pasture of 3 acres; and 2 pieces of land, one of which is an orchard and the other pasture called Downs's Orchards together 4 acres, which 3 pieces of land are in the possession of Edward Burnell at the annual rent of 10 guineas all which lands are in the parish of Tenbury, to hold to such trustees immediately after the death of G.H. for 500 years from the date of the indenture of such demise for such trusts and uses aftermentioned: in case there are one or more daughters or youngers sons of F. & G. on the further trust that the trustees shall within 6 months after the death of G.H. in case Frances shall be then living, by sale or mortgage of the 500 years in the hereditaments therein comprised or out of the rents & profits of the premises until such sale or mortgage, levy and raise £1,000 for the portions of the daughters & younger sons equally to be divided; & if only one such daughter or younger son then for his or her portion, provided in case any of the daughters or younger sons die before they are 21 or day of marriage, then his or her share to remain to the survivor of them equally to be divided among them; and until such portions shall become payable the trustees shall out of the rents & profits of the premises raise such competent yearly sum for the maintenance and education of such daughters and younger sons, not exceeding the legal interest of their portions; in case there are no such daughters or younger sons, or in case the £1,000 shall by the trustees be levied & raised by the ways aforesaid then in either of the said cases and at all times thenceforth the term of 500 years or the unexpired no. of years, shall cease or otherwise surrendered to the person at the time next in reversion or remainder of the premises; in case G.H. survives Frances having one or more daughters or younger sons, then the £1,000 shall not be raised out of the premises, but out of the estate at Kyrewood described in the recited indenture of release and every clause herein contained shall cease & be void; and every article herein contained is meant in order to secure a maintenance and education for any daughters or younger sons of the marriage and the portions of them in case Frances shall survive G.H. & the same to be payable in the lifetime of Frances and not at the decease of G.H. & Frances and the survivor of them as mentioned in the recited settlement.
