Under the provisions of the Leeds Waterworks Act, 1838 (7 Wm. IV and 1 Vict., c.lxxxiii), section 18, impartial referees were to be appointed 'to ascertain and determine, by gauges or other sufficient and proper means, what is the usual or accustomed quantity of water flowing from... springs, waters and sources' of landowners whose rights might be adversely affected by the works proposed, in order to ascertain whether any 'diversion, injury or diminution' was caused as a result of the company's works. The records made were to be deposited with the clerk of the peace for the county.
