(Given by Edward R.J.Howe, 7 New Square, Lincoln's Inn) upon an intended conveyance of the farm at New Fishbourne from the devisees of Maria Wilmshurst, decd, to her son, Edwin Wilmshurst
The testatrix, after devising her real estate upon trust for sale, gave to her said son the option of purchasing the above farm "devised to me by my late dear husband" for £2,500. The question at issue turned on the fact that Mrs. Wilmshurst had had to sell some of the farm to the London Brighton and South Coast Railway Company [see Add Mss1145], and had purchased a piece of adjoining surplus land [see Add Mss1146] which had been cut off by the Railway.]
