Recites that in pursuance of an order in Chancery in William Gregory Williams, esq., Edward Gregory, clerk, and Daniel Gregory esq. and Geo. Gregory, only son of Daniel Gregory, an infant, complts., v. Geo. de Ligne Gregory esq. deft., dated 2 July, 1782, a commission of partition issued out of the Court to certain commissioners who viewed the estates in question and divided them into two equal parts, one to the complainants upon several uses and trusts, according to the deed of 30 May, 1747, and the other moiety to be allotted as the share of Geo. de Ligne Gregory
The property comprised in the 1st schedule is allotted to the complainants, subject to the contingendes expressed in the deed of 30 May, 1747. The property comprised in the 2nd schedule is allotted to the defendant, to be held by him, his heirs and assigns, in severalty, pursuant to the order mentioned in the Commission.
Recites that it was directed by the order that in case Susanna Gregory, the daughter, or any of the parties should appear to have paid any sum of money on account of the expenses in enclosing of the property, then the Commissioners should consider the same in allotting share. They find that after the Act of 1768 for enclosing Rempstone, Susanna Gregory and the defendant, George de Ligne Gregory, being jointly in possession, each spent £600 and upwards; and that after the Act of 1770 for enclosing Wyville heath, they paid equal shares of the expenses of enclosing a large part of the heath, amounting to £400 each and upwards.
1st schedule: property in Denton and Rempstone
2nd schedule: property in Harlaxton and Wyvill cum Hungerton.
Depositions of witnesses examined on 22 Oct. 1782 in par. St. Mary, Nottingham by virtue of the same Chancery Commission, on behalf of the complainants.
Interrogatories to be exhibited on the part of the complainants for the examination of witnesses.
