Recital of lease and release of 21 and 22 November 1740 the release between John Ingram, Doctor of Physic, of the City of Coventry and Catherine his wife (who was widow and administratrix of Thomas Gorsuch late of Shrewsbury, watchmaker, deceased) (1) Edward Freeman, mercer, of Shrewsbury and Elizabeth his wife, a daughter of Catherine by Thomas Gorsuch (2) Timothy Seymour and William Held (3) William Harley (4) Catherine has given and appointed the sum of £120 which was secured by mortgage on the messuages, and lands aftermentioned to Thomas Gorsuch deceased, to be paid to her daughter Elizabeth as part of her distributive share of her late father's effects; in consideration of £120 from Harley to Freeman in right of his wife, Seymour and Held, Ingram and Catherine his wife by direction of S. and H. grant to Harley the piece of land called the Moat Hill alias Tainter Hill alias Castle Hill adjoining to a piece of land now belonging to a Mr. Webb on the N. side and bounded with the River Severn on the E. side and by the Castle of Shrewsbury on the S. side and heretofore purchased by William Held late of Shrewsbury deceased father of W. Held party to this, from Henry Podmore, Elizabeth his wife and Eleanor Thomas, widow; and the several messuages and other buildings which are erected on the piece of land since the purchase (except one messuage then or late in the possession of Thomas Pemberton bricklayor, and one other messuage then or late in the possession of James Birch, brickmaker and shoemaker:) to hold to Harley, his heirs and assigns forever, subject to a proviso to be void if T.S. and W. Held pay to Harley £125 10s. Whereas default was made in payment of the £125 10s. by means of which the estate of Harley in the premises became absolute in the law; Whereas there is now owing to W. Harley £120 the interest being paid, which sum Wingfield has agreed to lend T.S. and W. Held to pay off Harley; Now in consideration of the £120 to Harley from Wingfield, Harley with the consent of T.S. and Held assigns the property and T.S. and Held grant and confirm it to Wingfield, already in his possession by a lease of the previous day; to hold to Wingfield, his heirs and assigns to their use forever, freed and discharged from the proviso for the redemption of the premises, subject to the following proviso that if T.S. and Held pay to Wingfield £126 thus: £3 on the 21 June next, and £123 on 21 December 1743 then this assignment shall be void and then Wingfield shall at the request and cost of Seymour and Held reconvey and assign all the premises to T.S. and Held discharged from all incumbrances committed by Wingfield; and Harley covenants that he has not incumbered the premises; Seymour and Held covenant to pay the sums in the proviso, and are lawfully seised of the premises of a lawful estate of inheritance without any condition or limitation of any use to determine and invalidate the same or to impeach this mortgage (except the leases hereinafter mentioned to be granted to several persons to build on the premises and Harley, Seymour and Held or one of them has full power to convey the premises to Wingfield; it shall be lawful for Wingfield after breach of the proviso peaceably to enter and hold the premises and the rents and profits of the same without suit from T.S. or W. Held, free from former grants and incumbrances except several leases heretofore granted by W. Held deceased. i.e. 1 lease to Thomas Felters for 99 years of part of the premises on which is reserved a yearly rent of 6/-; a lease to Henry Jones for 99 years of another part of the premises, rent 5/-p.a
A lease to Thomas Hughes for 99 years of other part of the premises, rent 5/- p.a., Lease to Clare Blackway, widow for 99 years of other part of the premises rent 7/- p.a.; Lease to Thomas Betton for 99 years of other part of the premises at 4/- p.a.; Lease to Elizabeth Williams for 99 years of part of the premises, rent 7/- p.a.; Lease to James Birch for 99 years of part of the premises rent 6/- p.a.; Lease to William Burchall for 99 years of part of the premises rent 7/- p.a.; 2 leases to Bridget Hollins and William Sargeant for 99 years of part of the premises rent 8/- p.a.; Lease to John Amos for 99 years of part of the premises, rent 5/- p.a.; Lease to Mary Killford, widow, for 99 years of part of the premises, rent 4/- p.a.; Lease to Thomas Amos for 99 years of part of the premises rent 4/- p.a.; Lease to William Wood for 99 years of part of the premises rent 6/- p.a.; Lease to Margery Amos, widow, for 99 years of part of the premises rent 4/- p.a.; Lease to Henry Richards for 99 years of part of the premises, rent 6/- p.a.; Lease to John Phillips for 99 years of part of the premises, rent 4/- p.a.; and such other leases as shall hereafter be granted by Seymour and Held whereon the full value of the ground rent shall be reserved payable yearly to them and their heirs during the terms granted; if default is made in the payment of the sums in the proviso, T.S. and Held, their heirs, and every other person(s) except the several tenants aforementioned and except Thomas Pemberton and James Birch, having any right to the premises, shall at the request of Wingfield at the cost of T.S. and Held make a further assurance in the law of the premises to Wingfield; and it is agreed between the parties that Wingfield shall accept interest for the £120 at the rate of 4½% in case Seymour and Held pay to W. on the days limited for payment of the interest or within three calendar months next after each day; and it shall be lawful for Seymour and Held to hold and occupy the premises and to receive the rents and profits to their use and to grant building leases on any part of the premises reserving the full value of the ground rent until default shall be made in performance of the proviso without suit of Wingfield.
