Indenture, assignment of mortgage.

(1) Thos. Webb of Sherborne Warks., gent., sole exor of Wm. Ward late of Woolston Warks., gent. who was surviving exor of Rich. Hinde late of Lilburne Nhant gent. during minority of Sam. Hinde of Lilburne, gent., grandson of Rich Hinde.

(2) Rob. Spence of Braybrooke Nhant, yeo.

(3) Sam. Hinde as in (1) above.

(4) Rich. Hinde of Oxford, mercer, grandson of Rich. Hinde.

Reciting mortgage dated 26 April 1709 by which Edward Spence of Braybrooke Nhant, yeo., father of (2) and (2) for £100. leased to Wm. Ward and John Farndon of Woolston, gents., Hampton Gate Ridgeway Close (9 a.) in fields of Braybrooke, then in tenure of Edward and Rob. Spence bounded by land of Thos. Marshall on west and John Underwood on south, for term of 1,000 years for pepper corn rent, void if £102. 10s. paid at specified term, that £102. not paid, etc.; further reciting that £100. principal sum (all interest paid) still owing and that it is agreed that (4) shall have above £100. as part of will of Richard Hinde and that residue of term of 1,000 years be assigned to (4), now for nominal sum to (1) & (2) paid by (4), (1) at request of (3) & (2) to (4) premises as above with residue of term of 1,000 years, void if (2) pays (4) £102. 10s. on 26 October 1720, (2) to enjoy premises until non performance of such payment.
