Cons: £370 to Brooke.
Feoffment in a moiety of a capital messuage called St. Johns in the Low Town in the parish of St. Mary Magdalen in Bridgnorth (where Lancelot Taylor gent dec. formerly dwelt, after Richard Cresswell esq. also decd. or assigns, now John Brooke, Thomas Gitton, and William Cureton or their assigns) and one undivided moiety of all outhouses etc. stables, coachhouse, yards, gardens, courts, backsides, etc., in all 2 a 3 r, extending E, from the Mill Street to a hedge or fence which divides the premises from land late parcel thereof but now the sole property and inheritance of Thomas Gitton called the Treepiece otherwise the Elm Tree Piece one moiety of which said piece was purchased by Thomas Gitton from William Ryder; a moiety of 2 seats at the lower end of the parish church of St. Mary Magdalen near to the south door, with the wall of the church S and W the font N and the passage or cross isle E; and one full moiety of all ways, waters, rights, etc; this moiety of the capital messuage was formerly the estate and inheritance of John Ryder the elder late of Bridgnorth surgeon decd. and devised by his will dated 4 April 1748 to his son William Ryder and heirs, who conveyed it 26 and 27 March 1756 to use of John Brooke and heirs; (reserving 2 pews in the nave or south isle of the parish church in which Ann Congreve widow and her family usually sit, and also except all other pews in the church of St. Mary Magdalen and the parish church of St. Leonard in Bridgnorth which heretofore did belong or were appurtenant to the said messuage, and also the moiety of the Tree Piece aforesaid) with all deeds Brooke has or can come by without suit at law, to hold of the chief lord etc. Covenant that the title is good, for quite possession, for further assurance. Further consideration: £370 to Gittons.
Gittons conveys his moiety of the messuage, a moiety of the pews at the lower end of St. Mary Magdalen's, and a moiety of all easements (reserving as before)
Covenant that Gitton's title is good, for quiet possession, for further assurance. There is a rent of 13/7 payable out of the house and the Elm Tree Piece which in future is to be charged on the house only and Colley covenants to discharge it and indemnify Gitton. To prevent disputes about the boundary between the premises and a messuage and land of Thomas Gitton (Ann Congreve widow or assigns), it is agreed that Gitton shall maintain at his own cost the wall from Mill Street eastward to the nearer end of the brewhouse belonging to the premises (52 yards 1 foot) and that Colley shall maintain the fence or wall from that place eastward to the bottom or lower end of the Elm Tree Piece, the height of the walls in each case to be 8 ft from the surface of the ground and be erected on the same foundations as the present walls or fences; and that Colley shall maintain the fence that divides the Tree piece from a garden belonging to the premises. Each party shall have the right to come upon the other's land at reasonable times to repair the walls.
