Description

Settlement.

(i) Rev. John Clayton, clerk, rector of Norton-by-Twycross, son and heir apparent of Ann Clayton, now of Coventry, widow.

(ii) a. Rev. Andrew Burnaby, clerk, vicar of St Margaret's, Leicester, and b. Elizabeth Burnaby, spinster, his daughter.

(iii) a. Rev. Andrew Burnaby, jun., clerk, eldest son and heir apparent of (ii)a, and Richard Clayton of Leicester, apothecary.

(i) Conveys to (iii):

Property: Brockhill Hole Close (7 acres) in Rotherby formerly occupied by William Glover, then by (blank) Robertson; and ¼ of: a messuage in Braunstone, and Paddocks Leys Close (12 acres), Hatt Slade Close (10 acres), and Nether Meadow (5 roods), and Forest Close (3 acres) in Leicester Forest, all occupied by William Chandler, 7 acres of pasture in Broughton Astley occupied by John Phillips, and 1 yardland in Cosby formerly occupied by Thomas Biggs.

In trust to: (a) any uses later specified by (i);

(b) (i) for life;

(c) To uses specified by (ii)b should she survive (i); and

(d) The sons and then the daughters of (i) and (ii)b.

Consideration: The proposed marriage of (i) and (ii)b and £500 marriage portion.

(i) To pay £1,000 to (iii) within 6 months after the marriage.

In trust: (a) to invest it in securities or land;

(b) (i) and (ii)b to receive the income during their lives;

(c) The principal to be paid, after their death, to their children in the proportions specified by them during their lives;

(d) Until the children reach 21 years the interest to be spent on their maintenance and education; and

(e) If no children survive their parents and reach 21 years the money to be paid as divided in the Will of (i).

Proviso: (a) if (i) survives (ii)b and all their children the money to be returned to him;

(b) (i) and (ii)b or the survivor of them may have the £1,000 or part of it invested in land; and

(c) The costs of administering the trust to be paid out of the £1,000.
