Lease and release - marriage settlement

1. Edward Edwards snr. of Careghofa, Denbigh, gent.

Marriage intended between Edward Edwards jnr. and Elizabeth Duckett.

John Duckett has agreed to pay off a mortgage of £500 to Mr Thomas Williams affecting part of the estate intended to be settled on his daughter in jointure.

Edward Edwards snr. in consideration of the marriage and love of his son Edward, and in consideration of £500 to be paid by John Duckett in discharge of the mortgage to Thomas Williams, conveyed to John Nightingale the capital messuage called Llwynygo with lands being in Upper and Lower Maesbrook, Kinnerley (Robert Pool); the other messuage and lands in Upper Maesbrook (William Payne); the other messuage and about 2a land belonging in Upper Maesbrook (Morris Thomas) - all heretofore bought by Edward Edwards snr. from John Mytton, Esq.; other messuage and lands (Peter Davies) bought by Edward Edwards snr. from the Rev - Mytton, clerk.

To John Nightingale on trusts:- the last messuage to Edw. Edwards jnr. for life, then to Elizabeth Duckett for life in satisfaction of dower, remainder to John Duckett for 600 years; the other houses and lands to Edward Lloyd for 500 years, then to Edw. Edwards snr. for life, then to Edw. Edwards jnr. for life, then the premises to the use of John Duckett for 500 years, remainder to the use of the 1st son of E.E. by Elizabeth and the corporeal heirs of such son, remainder to other sons of Edw & Eliz. successively and the corporeal heirs of such sons, remainder to daughters of E.Edwards jnr. and Eliz. equally between them as tenants in common and not as joint tenants and their corporeal heirs, remainder to the right heirs of E.Edwards snr. forever. As for the term of 500 years limited to Edward Lloyd on trust that he, by direction of E.Edwards snr. by sale or mortgage of the premises in the term of 500 years raise a sum not over £500 for such purposes and E. Edwards snr. shall direct. As for the terms of 600 years and 500 years limited to John Duckett on trust that if E. Ewards jnr. has by Elizabeth any younger child or children besides an elder or only son, John Duckett shall after the death of E. Edwards jnr. by sale or mortgage of the terms of years raise for portions of such younger children £500

Edward Edwards assigned to Edward jnr. all the stock of cattle, horses, sheep and pigs and implements of husbandry and all right of Edward snr. in the messuage and lands in Carreghofa which he now holds as tenant to Sir Thomas Jones, knt. and the profits thereof from 25 March next, to Edward jnr. forever, Edward jnr. paying all rent due, and paying to Catherine Edwards youngest sister of Edward jnr. £100 within one year next after the death of Edward snr.

John Duckett covenants to pay the principal sum of £500 due by mortgage to Thomas Williams on or before 31 August 1781 and the interest due after the marriage until the principal is paid.
