Recital of indenture of 14 February 1795
(1) Richard Betton of Shrewsbury
(2) Aaron Foster of Taunton co Somerset clerk and Mary Anne Foster spinster his sister
(3) John Bright Betton of Shrewsbury esq
Consideration: marriage intended between Richard Betton and Mary Anne Foster
Richard Betton covenanted to settle property of the clear yearly value of £500 to the uses therein expressed, that is, to use of Richard Betton (decd) for life with a limitation to trustees and their heirs during his life and after to use that Mary Anne his wife should receive an annuity of £200, remainder to trustees for term of 500 years, to use of sons in succession and heirs male, or to Richard Betton and his heirs and assigns for ever. The term of 500 years was in trust for younger children to raise portions, viz if one, £1000, if more £3000 shared among them
No settlement was ever executed in pursuance of these articles
Richard Betton now decd left a will dated 11 July 1812 and devised all real estates at Great Berwick, Newton and Wentnor or elsewhere in co Salop to his brother John Bright Betton as the Rev. John Bright Bright of Totterton House, and Richard Atcherley of Marton Hall esq their heirs and assigns to use of John Bright Bright and Richard Atcherley for term of 1000 years on trust with remainder to use of his son Richard Betton (party) his heirs and assigns for ever. The term of 1000 years was in trust first to secure payment of testator's wife of an annuity of £200, and subject to this on trust to raise £1000 for his daughters Mary Ann and Harriet within 6 calendar months after his decease with 5% interest, and on further trust to raise £3000 for all the testator's younger children living at the time of his decease to be paid at age 21 or to daughters at marriage with interest at 5%. This provision was stated to be in lieu of portions to which they might be entitled under his marriage settlement
The testator died June 1819; the will was proved 30 Oct 1819 in the prerogative court of the Archbishop of Canterbury.
Richard Betton deceased left at the time of his death 3 children by Mary Anne Betton, namely, Richard Betton party, his only son, Mary Anne now wife of Thomas Foster esq a Captain in H.M. Royal Regiment of Engineers, and Harriet who on 18 March 1829 intermarried with Thomas Hosmer Rimington Richard Betton party having paid Rimington and his wife £2000 (moiety of the sums of £1000 and £3000) they have agreed to execute a release
Cons: £2000 in discharge of Harriet's portion.
