Description (What the record is about)
-
1. Robert Slaney the elder of Hatton Graing, Idsall als Shiffnall gent.
2. Robert Brooke rector of the parish church of Ryton.
Slaney has lately erected a slitting mill in Ryton in the Mill Bylett near adjoining to a River called Worfe or Ryton Brooke, where a little below the slitting mill a corn mill and paper mill formerly stood but were lately demolished and burnt downe. Slaney has raised the banks, made a damm and flood gates across the river near the new mill much higher than formerly and the water drowns a great part of a meadow belonging to the Rectory of Ryton called the Parsons meadow near a bridge or ford called Adams Ford. The water has also overflowed other meadows from which Brooke and his predecessors were accustomed to receive tithe.
Counterpart.
Slaney revokes all uses declared concerning the mills and lands, and in satisfaction for the damage caused or to be caused to Brooke and his successors in Parsons meadow and for loss of tithe, gives him part of an inclosure as now divided (1 acres abating 12 perch) called the Ditch meadow in Ryton (Slaney) bounded with a parcel inclosed of Brookes belonging to the Rectory called the Parsons Bottoms (W) the river called Worfe or Ryton Brook (N and E) and the other part of the meadow (Margaret Mitton widow) (S). In the part of the meadow hereby granted is a dole meadow ground belonging to Brooke as parson of Ryton. To hold to him and successors. Warranty. Slaney further gives him and his successors an annuity of 25s out of a close in Ryton called the Mill Bylett and the mills on it lately erected or to be erected and out of a messuage adjoining the mills in possession of Robert Slaney, to be paid to the Rector and his successors at the Parsonage house at the feast of St. John Baptist between the hours of 12 and 3 in the afternoon without any deduction. Covenant that if the annuity is 20 days unpaid, Slaney and his heirs etc. shall forfeit 10s if demand has been made and 5s if no demand, for every day over the 20 days, and the Rector may enter on the mills and enjoy them until satisfied and may take a distress. Slaney covenants that he is the lawful owner and proprietor of the messuages, mills, meadow and premises out of which the rent is payable, and also of the meadow conveyed, and that he has power to convey. Covenant for quiet possession. The Ditch meadow and the rent shall be exonerated from any possible claims on them. The mills shall always be liable to distrain by the Rector and the rent paid without abatement. Slaney shall pay all taxes etc. on Ditch meadow. Covenant for further assurance within the county, any fine to be of use of Brooke and his successors. Brooke agrees during his life to allow Slaney and his servants to pound up the water. If his successors ever prosecute any action against Slaney for pounding up the water and letting it overflow and drown Parsons meadow, then this indenture shall determine.
Signature of Robert Brooke.
