Lease and Release.
In consideration of the marriage of John Davies and Margaret Mathews and £170 M.Ms marriage portion. Release by John Davies to Thomas Downes and Richard Mathews of a capital messuage in Peniarth called ey yn y Llwyd Allt and the tenement wherin Mary Humphrey lives and lands called the great meadow 11 acres; the little meadow 2 acres, Cae Skibor 4 acres, Cae Gwenith 5 acres, Cae Ennor 3 acres, Cae Enner meadow 3 acres, Caebychan 2 acres, Cae Mawd 4 acres, Cae Bwlch 6 acres, pant gwin 3 acres. Erw hir 2 acres, the woody ground 7 acres and the close by the little House 1 acre, with commons sheepwalks and turbarys, profits, to the use of Downes and Mathews so that a common recovery may be suffered. John Humphreys to bring an action on a writ of entry surdissesin.
Downes and Mathews then vouch to warrenty John Davies who vouches the Common vouchee who departs in contempt of the court so that a common recovery shall be had and the specified uses suffered - an annuity of £4 to Mary Davies as long as John Davies shall live and after his death £5 and to David Davies an annuity of £6. The estate to the use of John Davies and, after the determination of that estate to the use of Downes and Mathews, in trust so that after the death of John Davies, Margaret his intended wife may have an annuity of £12. And the reversion of the inheritance to go to the eldest son and his heirs or (in order of birth) any further sons or in default of this to any daughters in order of seniority. If it has to descend to a daughter the land can be charged with a sum of money not exceeding £200 for the portioning of his younger children. During the joint natural lives of John and Margaret the land may be conveyed bargain sold by joint instrument providing land of equal value is purchased.
