Description

Release made between Sir Henry Oxenden of Broome, Kent, baronet, the Right Honourable Henry Lord Porchester, the Honourable and Rev. William Neville, Rector of Burghclere, Hants, of the first part, Frances Harries of Charing Cross in the parish of St. Martins in the Fields, widow, of the second part, Joseph Bullock of Caversfield, Bucks, esq., and George Richards late of New Inn, now of Berners Street in the parish of St. Marylebone, esq., of the third part, and James Fleming Baxter of Ludlow, esq., of the fourth part.

Whereas by indentures of 20 and 21 January 1775 made between John Harries and Frances Harries, and John Cotes of Woodcote; See 465/172. By indentures of lease and release between John and Frances Harries and George Duke of Manchester etc, September 5th and 6th 1776. See 465/174 and 175. By indentures of lease and release February 7 and 8 1782 between Frances Harries, widow, and John Swinnerton Dyer, Joseph Bullock, and George Richards, 2nd part. 465/178.

Whereas John Swinnerton Dyer, wishing to decline the trust made in above indenture, by indenture of lease and release, July 1788, conveyed all interest in mortgaged premises to the use of Joseph Bullock, and George Richards. Whereas by indentures of lease and release, September 28 & 29 last past, September 1789, between Mrs. Frances Harries and others to and James Fleming Baxter. see 465/179,180. Whereas £4000 still due and owing to Sir Henry Oxenden, Henry Lord Porchester, and William Neville, on security of recited mortgage, but all interest paid (mortgage September 1776, 465/174,175). Whereas James Fleming Baxter agreed to discharge £4000, and to recover the mortgaged premises. Present indenture witnesses that for consideration of £4000 paid by James Fleming Baxter to Sir Henry Oxenden, Henry Lord Porchester, and William Neville, as discharge of principal money owing on recited security, Consideration of 10s. paid by James Fleming Baxter to Frances Harries, Joseph Bullock, George Harries premises released to James Fleming Baxter and heirs by Sir Henry Oxenden etc.

All messuages, tenements, lands, tithes impropriations etc. in lease a release 5 & 6 Sept 1776 To have and hold by James Fleming Baxter and heirs, acquited and discharged from recited mortgage.

In witness of above agreement signed by Henry Oxenden, Lord Porchester, William Neville, Frances Harries, Joseph Bullock, G. Richards.

Sealed and delivered by Sir Henry Oxenden, Henry Lord Porchester, Frances Harries, Joseph Bullock George Richards, in the presence of Edward E. Eden Daniel Welstead, by William Neville in the presence of Richard Arnold, Daniel Welstead.

March 22, 1812. Examined with the original deed of which this a true copy by us Thomas Coucher James Yeomans. Paper draft, 7 sheets fastened together.
