Reciting bargain and sale enrolled of 15 January last (1514/582) creating tenant to suffer a recovery of Salop property to such uses as Sir E.S. on his first marriage should direct.
Recital of bargin and sale enrolled of 15 January last between Sir E.S. (1), Farrow Eden (2) John Mann (3) making Eden tenant to suffer a recovery of the Manors of Ash alias Esh, and Ushaw, Nunstainton alias Stainton Grange, Baraton, N. Harrington, W. Harrington and Middle Harrington, High and Low Embleton and the moiety of the manor of Woodham, all in Co. Durham, and property elsewhere there. Nann demandant and Sir E.S. vouchee, to the uses of Sir E.S.'s marriage settlement. Recovery suffered for Salop estates Hilary term last and for Durham property 15 April last.
Marriage intended between Sir Edward Smythe and Mary Giffard, whose portion was £6000, that is £4000 to which she was entitled by the settlement on the marriage of her father Peter Giffard to Barbara Throckmorton, decd, the which Samuel Mabbat had agreed to advance to the surviving trustee of the term of 200 years on having an assignment by way of mortgage of the said term to secure repayment, and on £950 the voluntary gift of Peter Giffard and of £1,050 from Mary Giffard of Long Birch her Godmother.
As for the advowsons in Salop and Durham and New House Farm in Durham, part of the Manor of Eah - the the use of Sir E.S. and heirs forever. Best of property - to Blount & Oteley for 99 years to Sir E.S. for life. Mary Giffard to receive for her jointure £600 p.a. out of the property in the recoveries, except the advowsons and farm. The same property, except an excepted above, from the death of Sir K.S. to the use of Baggot and Throckmorton for 500 years, to the use of the sons of Sir E.W. by Mary and their sons; in default to other sons of Sir E.S. by another wife, in default to Walter Smythe, brother of Sir R. for life, and his sons; if none, to daughters of Sir E.S. as tenants in common; if none, to the daughters of Walter S.; in default to Sir E.S. and his heirs forever. As for the term of 99 years to Blount & Oteley, on trust during the joint lives of Sir R.S. & M.G. to raise £100 p.a. to uses. M.G. appoints. Rest of profit of said property to Sir K.S. for lives of Sir E.S. and M.G.
As for the term of 500 years to Baggott and Throckmorton, on trust to pay £600 annually as an annuity to M.G. as above and to raise the portions for younger children, of £8000 if more than 1 younger child and £6000 if only one besides the eldest son. If the daughter goes abroad and becomes a nun of an order approved by the Church of Rome, then £600 to her as her portion and to a son taking Holy Orders £600 or an annuity of £40 p.a.
