Walter Smythe of Tonge Castle, Esq., is bound to Sir Edward Smythe of Acton Burnell, bart in £20,000.

Recital that Sir Richard Smythe of Esh, Co. Durham, late of Wenlock, bart. decd. diedintestate and letters of administration were granted to Sir John Smythe, bart, brother of Sir Richard. Clare Smythe, daughter and only child of Sir Richard was living at his death, and not able to manage her affairs. Sir John S. by will appointed Peter Giffard of Chillington, Staffs, Esq., decd., Walter Smythe and Constantia Smythe his daughter, wife of the Hon. Marmaduke Langdale, Esq., executors and executrix of the said Sir John's will, and Peter G. & Const. Langdale took on the executorship to Sir Richard, and Peter Giffard by will appointed Sir Robert Throckmorton and Sir Windsor Hunlock, executors. Administration of the goods of Sir Richard S. remaining unadministred granted to Sir Edward Smythe. Clare died unmarried and intestate 24 March last - letters of administration granted to Sir Edw. S. Sir E.S., Walter S. & Const.L. are next of kin of Clare, & so entitled to the whole of her personal estate. By account taken this day of her personal estate, and after deducting charges of administration, it is £32,903 9s 11d between Sir E.S., W.S. and C.L. Share of Walter, £10,967 16a 7¾d paid to him this day by Sir E.S. Walter to indemnify Sir E.S. If he does so, then bond will be void.
