Indenture between Humphrey Sandford of the Isle of Up Rossall esq. and Elizabeth his wife 1st part Thomas Evans of Clungunnus clerk 2nd part, Thomas Bayley of Preston Brockhurst gent. 3rd part.
Witnesses that for the assuring of the pieces of land mentioned for the uses and trusts expressed and for consideration of 5s. paid to Humphrey Sandford by Thomas Evans, release of two pieces of land called the Upper Bottom Piece, or the Feggy Piece and The Lower Bottom Piece in Up Rossall now in occupation of John Weston, with all appurtenances; to hold by Thomas Evans to the use of such persons and for such trusts as Humphrey Sandford shall appoint, and immediately after the death of Humphrey Sandford subject to term of 500 years, to the use of Elizabeth Sandford for her life, to the use of Humphrey Sandford and his heirs. Concerning the term of 500 years limited to Thomas Bailey, agreed between the parties, that Thomas Bailey shall out of the profits and issues of the premises or by sale or mortgage of the premises raise £600 to be paid to such persons as Elizabeth Sandford shall appoint, in default of which to pay £600 to the younger sons and daughters of Humphrey Sandford and Elizabeth with interest on the same to be computed from the beginning of the term at the rate of 4%, and portions to be paid to the younger children when they become 21 years, or marry and interest to be used for their education and maintenance, as Thomas Bailey and his executors shall think fit. Humphrey Sandford guarantees to Thomas Bailey that at the time of the making of this indenture he is lawfully seised of mentioned pieces of land, and that he has full authority to grant the land and premises to Thomas Bailey, and that at the request of Thomas Bailey but at his own expense he will execute assurances for the better granting of the land, for which Thomas Bailey shall not have to travel more than one mile. Thomas Bailey shall not be accountable for any money received by virtue of the trust reposed in him, and that he and his executors shall be able to reimburse themselves for any expenses incurred in the execution of the trusts out of the rents and profits of the premises.
