Description

George Henry Nevill (1760-1844), youngest son of George [Nevill], Earl of Abergavenny, deceased; Richard Walpole of Dover Street in St George, Hanover Square, Middlesex and his youngest daughter Caroline Walpole of the same; trustees (Horatio [Walpole], Baron Walpole, Gerard William Vanneck of Heveningham Hall, Suffolk, bt, Thomas [Pelham] Baron Pelham and his eldest son Thomas Pelham)

Recites: intended marriage between GHN and CW; will of GN bequeathing his personal estate to his brother William Nevill and William Morgan of the Hill, Monmouthshire, esq in trust to pay an annuity of £200 to Mary Banister, spinster, now wife of William Yarnold of Knightsbridge, Middlesex, brewer, the residue to be held to the use of GHN, 14 Aug 1779; settlement by which William Nevill and William Morgan secured the annuity by agreement to hold £5,000 secured to GHN by mortgage from [Henry Pelham-Clinton] Duke of Newcastle, of Nottingham Castle and lands, assigned to them by GHN 5 and 6 Apr 1786 (details given), 15 Oct 1785

GHN has agreed that the £5,000 shall be assigned to the trusts of this settlement, with £7,000 and £5,000 stock (part of which is the portion intended to be given by RW to CW, the rest belonging to GHN), which have been transferred into the names of the trustees

Trustees shall hold the sums in trust for GHN for life, then to CW for life, remainder to the child or children of the marriage.

Recites will of Richard Walpole of the City of London, devising property (details) at Croydon, Surrey, and in Middlesex to HW, Joshua [Vanneck], Lord Huntingfield and Samuel Long (executors together with Beeston Long) in trust for sale (subject to life interests of his wife Margaret Walpole and servant John Commins in the Middlesex property), the proceeds to be added to his personal estate and divided among his younger sons Robert and Edward and his daughter Caroline, 5 Jul 1797; codicil instructing executor to assign her share to the trustees of the settlement on her marriage to George Henry Nevill, 8 Mar 1798; death of RW 18 Aug 1798; probate 17 Sep 1798; death of Margaret Walpole May 1818. HW and Beeston Long are the surviving executors of the will, and TP is the surviving trustee of the settlement; appointment of new trustees, 1 Oct 1812; sale of Croydon property; sale of Dover Street property to Peter [King], Lord King for £5,097 10s 9d, 9 Feb 1819; £4520 6s 1d is left to be divided among Richard Walpole's younger children, of which a third (£1506 15s 5d) has been paid to the trustees of the settlement who have bought stock; the whole residue of the personal estate of Richard Walpole has now been collected (except for the product of the sale of St John's Square property, not yet sold), and a third part has been transferred to the trustees, who have bought £23,096 13s 11d 3% Bank Annuities.

Trustees declare they will hold the sums on the trusts expressed of the settlement.
