Description

1) Timothy Seymour, gent. of the Isle, in the parish of St. Chadd.

Elizabeth his wife.

2) Robert Baskerville, gent. of Shrewsbury.

3) John Thornton, apothecary, of Shrewsbury.

Recital of indenture of 3rd August 1736 between Seymour (1) Robert Baskerville (2), T.S. in consideration of £600 from R.B. demised and granted to R.B. the messuage in the High Street otherwise Hay Street in Shrewsbury theretofore in the possession of Seymour, now of Thomas Mason, draper; the other messuage in Kill Lane, Shrewsbury formerly of Timothy Talbott, linen draper, and then and now of Samuel Downes, innholder; the other messuage in Duns Shut otherwise Seymours Shut called Wingfield House now or late of Samuel Downes and Thomas Gosnell, grocer; a messuage behind the walls of Shrewsbury thentofore of Joseph Trevor, shoemaker and now of Richard Humphreys, labourer; 3 stables thereunto adjoining, then or late in the possession of John Powell, Esq., and John Tayleur, Esq., and now in the possession of Seymour, Richard Mallard and Robert Phillips; the garden thereunto adjoining then in the possession of William Gorsuch, linen draper; and the reversion, remainder, title and interest; to hold to R.B. for 500 years for a peppercorn rent, subject to a proviso for making void the indenture if T.S. paid R.B. £13 10s. on the 3rd February next and £613 10s. on the 3rd August next, which was in 1737; Whereas there is now owing to R.B. £600 all the interest being paid; and now in consideration of the £600 by the direction of T.S. paid by Thornton to Baskerville, R.B. has assigned to Thornton the above property with all the deeds re it, to hold to J.T. for the residue of the 500 years; and Timothy and Elizabeth Seymour have ratified and confirmed to J.T. the property provided that if Seymour pays to Thornton £12 15s. on the 10th November next, and £612 15s. on 10th May 1740 then these presents and the residue of the term of 500 years shall cease and be void; and T.S. covenants with J.T. that he T.S. shall pay to J.T. £12 15s. on 10th November next and £612 15s. on 10th May 1740; R.B. covenants that he has not incumbered the property; T.S. covenants with J.T. that he or R.B. has full power to convey to J.T. and T.S. and Elizabeth after default shall be made in performance of the proviso at the request of J.T., at the cost of T.S. will make a further assurance in the law of the property; and next Easter term or before the end of next Trinity Term levy a fine, which shall be to the use of J.T. for the residue of the 500 years.

Receipt 30th July 1743 of £12 15s. being for half a year's interest from T.S. by J.T.

Receipt 30th September, 1745 from T.S. £12 15s. by J.T.

Receipt 17th May, 1746 from T.S. £6 by J.T.
