Sir Thomas Whitmore, Knight of the Bath, administrator of the goods of Dame Elizabeth Whitmore widow deceased, plt, on a plea of £54 debt v. John Wilks defendant.
Brief in case over tithes of grain and hay on 30 acres of land and 20 acres meadow in the parish of St. Mary Magdalene, Bridgnorth, belonging to the defendant, who for 8 years from 31st May 9 Charles II (1657) refused to pay the tithe due to Dame Elizabeth, the value of which (trebled) now comes to £54. An action was first brought at the Lent Assizes 1669 by Sir William Whitmore, the plaintiff's elder brother, and the defendant was then ordered to pay £6 for the first 4 years of non-payment.
Note that 'in the time of the late warrs', Mr. Weaver, owner of the Quatford tithes combined with the defendant who has 'one of the best farmes in the parish' to pretend that his land was in Quatford, 'and they beinge prevalent in those times And Sir William Whitmore's estate sequestred and his Evidences many lost and others mislayed, took advantage thereof-- but now the deft. some very lately told his father that he might thanke himselfe for this trouble and charge for he always told him that Mr. Weaver would leave him and this will be proved if occasion by John Lemm'.
