Inquisition taken at Wellington co Salop, 27 April 18 Eliz. (1576) before Richard Prynce esq. Thomas Staunton gentleman, freeholders and John Amyas gentleman, by virtue of letters patent "de diem clausit extremum" to Edward Herbert esq. Simon Kemsey esq, Robert Stury gentleman and the above 3 ( 2 a quorum) including Thomas Staunton), to inquire after the death of John Newton esq, by oaths of Richard Stevington esq, John Forster gentleman, Thomas Burton gentleman, Richard Forster gentleman, Thomas Cowper gentleman, Robert Dicher gentleman, Thomas Dicher gentleman, William Sambrooke gentleman, George Wellaston gentleman, George, Chesnheire yeoman, Henry Chesnheire yeoman, Leonard Hotchekes yeoman, Humfrey Raven yeoman, John Swyfte yeoman

The jurors say that John Newton died seized of the manor of Wynsburye co Salop, 20 messuages, 1 water mill, 600 acres land, 300 acres meadow, 2000 acres pasture, 100 acres wood, 600 acres furze and heath, 20s 4d rents, and rent of 30 hens in Wynsbury, Dudston, Espice, Churbury, Whyttorce, Heyghley, Stocton, , Hegedon and the town of Salop

They further say that John Newton and Elizabeth his late wife now also deceased were seized in right of Elizabeth in 10 messuages, 400acres land, 100 acres meadow, 1000 acres pasture, 100 acres wood, 400 acres furze and heath, 40s rents in Burlington and Hynton co Salop

They say that John Newton, being seized of the Wynsbury property, and John and Elizabeth of the property in Burlington and Hynton, in Michaelmas term 6 and 7 Elizabeth levieda fine and recovery to uses set out in an indenture new recited:

2. Sir Hugh Chelmendley knight, Richard Dodde son and heir of John Dodde of Clorsley esq, Richard Nassall of the Niche Malbanke gentleman and William Tenche of the town of Salop draper

The second parties have already, on 18 September 6 Elizabeth purchased an original writ of entry our sur dessesin in le pont directed to the Sheriff against John Newton and Elizabeth his wife now deceased, and demanded the property in the names of the manors of Wynsbury, Ampice, Heygley, Burlington and Hynton,120 messuages, 1 water mill, 1000 acres land, 500 acres meadow,3000 acres pasture, 500 acres wood, 1000 acres heath and bruer, £4.13.4 rent and the rent of 30 hens, Deedto land uses, property in Burlington and Hynton, part of the inheritance of Gryffyth Hynton her father, to use of John Newton and Elizabeth his wife for their lives and the survivor's; if they die within 11 years next, then the trustees to stand seized of the Burlington and Hynton part and take theissues for the rent of that time, after to use of Frauncis Newton son and heir of John and Elizabeth, and heirs of Frauncis' body, in default to use of heirs of the body of John and Elizabeth, in default, Elizabeth's right heirs.

It is further agreed that the recovery on the Wynsbury property and all other property on which no use has been declared, shall enure to the use that the trustees for the remainder of the 11 years shall take the issues, to such use as John Newton shall declare in his will; after to use of Frauncis Newton and heirs male of his body, in default the heirs male of the body of John Newton, in tail male, in default to John Newton for life, remainders as before, remainder to use of John Newton of London bastard son of John Newton the father and heirs male of his body, as that John the son pay to the issue female of his father then living and unmarried and the issue female of the said Frauncis and the issue female of any other issue male of John the father then living £400 equally divided amongst them, and also £100 among the daughters whether unmarried or not. Payment to be made at the Common Hall of the Town Salop on the 3rd feast day of St John the Baptist which shall happen after the deaths of John Newton and Frauncis Newton without issue male, between the hours of one and six of the clock in the afternoon - in that case, the trustees are to stand seized to the use of the heirs of the body of Frauncis Newton, or heirs of the body of John Newton the father, or the right heirs of John Newton

If both father and son die without issue male of their bodies and the money is not faithfully paid within the time appointed then the trustees are to stand seized to use of the heirs of the body of Frauncis Newton, in default the heirs of the body of John Newton the father, in default the right heirs of John Newton the father for ever

John Newton the father may during his lifetime by indentures between himself and any other person, properly drawn and signed and sealed, make leases for limited terms, u nder conditions

By virtue of this settlement and an act of 27 Henry VIII, possession as above

Elizabeth Newton died 2 August 9 Elizabeth (1567)

John was also seized in the manor of Hocculton co Salop 12 messuages, 6 cottages, 1 water mill, 2 dovecotes, 12 gardens, 12 orchards, 100 acres land, 300 acres meadow. 1000 acres pasture, 100 acres wood, 1000 acres furze and heath and 40s rents in Hocculton, Prestes Weston, Colde Weston, Hagley, Little Weston,Woderton and Chyrburye 19 April 1574, 16 Elizabeth, at Heighley, made his will, now shown:-

The rents of all his lands in Wyneburys, Churburye and the residue in the Hundred there and in the town of Salop Hynton and Burlington whereof there is a true rental of the tenants' names etc subscribed with the testator's own hand annexed, to be received by a bailiff to be names by the testator's friends, parties to the recovery, and paid over by him as every estate shall end to the executors to be for purposes of the will - to John Redge the younger gentleman and assigns the testator's farm at Heyghley for 4 years yet to come, with the water mill, during the nonage of the testator's son Frauncis Newton, paying the rent of £10 every half year. He gives his brother in law Mr William Tench his farm in Wyneburye (Olyver Rired) for 21 years if Jane the testator's natural sister his wife live, paying £24 The price of such of the testater's goods as shall be sold and debts due to him with the yearly rents of all lands shall be allowed yearly for the exhibition of his son Frauncis from the day of the testator's death of £6.13.4 until he is 14, during which time his father wills him to be brought up with Mr Aston now schoolmaster at Shrowesbury or some other discreet honest and good scholemaster of grammar schole, from the age of 14, he shall have allowed to him until he is 18 £136s 8d for his exhibition in the University of Oxeforde or Cambridge. From 18 to 21 he is to have £20 for maintenance in the Inne of Chancery and Court. There may be some surplus, in that case it is to be employed upon him as need requireth. And surplus rents to be received by the executors and put in a chest with locks and several keys, to be kept by the executors and one key for the son to whom he bequesths the same with the residue of his goods. The executors expenses to be paid. The testator gives out of the farm where George Savage dwells. 30s a year for life to Hughe Whatley

He may distrain for the sum. The testator gives Richard Towe his servant his farm in Peaybryae (Bostocke lately dwelt there) with lands for life are £4 rent He wills that Davyd George and Gwen his wife shall occupy with as many chattels as they now have is Whitrey for 21 years and have the pastures that he now bath at the present rent

The testator bequeathe to Anne, Mary and Cicelie his 3 daughters, besides the former bequest, the issues of his farm in Cowle for 5 years after the expiration of the lease which Richard Pryace gentleman now has, equally divided between them, provided that if any daughter die before marriage, them the issues to be divided among the Survivors

25 April last John Newton died at Heighley

The propertyat Wyasbury, Dudston, Espice, Chirburie, Whitteroe, Heighley, and Egedon are held of the queen as of her castle of Mountgomery by fealty in free socage and in worth besides reprises £17

The property in the town of Salop in held of the queen in free burgage of the town of Salop and is worth besides reprises 40s

The manor of Hoccleton and property in Hocculton, Prestes Weston, Colde Weston, Hagley, little Weston, Woderton and Chirburye are held of the queen as of her lordship of Mountgomery which is parcel of the Marcher lordship, in socage by fealty and rent of one steel point and one red rose at the Nativity of John the Baptist

The manor of Hocculton is worth p.a. besides reprises £8. John Newton died 25 April last 18 Eliz. Frauncis married on 19 November 1571 1d Eliz. Mary daughter of Reginald Curbett esq deceased late one of the Justices of the Queen for plens coram regina - Mary is alive at Stooke super Tyerae Frauncis is under the age of 21, viz 18 and over on the day of the taking of this inquisition. John Newton held no other land etc when he died
