Whereas Seymour by his bond of 21st September 1743 became bound to Margaret Lee in the penal sum of £140 conditional for the payment of £70 to her on the 21st March then next following with interest at 4½%; and whereas T.S. By another bond of 25th April 1744 became bound to Margaret Lee in the penal sum of £600 conditioned for the payment of £300 on 25th July then next ensuing with interest at 4% and covenant with her that the capital messuage and lands in the mortgage should stand and remain a security for the £300 over and above the £1,100 and interest and that the premises should not be redeemed until the £300 and interest should be also paid; and whereas T.S. and M.L. have stated and settled accounts between them to the day of the date hereof and there now remains due to her the principal and interest on the securities the sum of £2,764 9s. 9d. and whereas T.S. has occasion to borrow £100 to pay off a debt due to Thomas Lee and has taken an assignment of his security bearing equal date herewith making £2,864 9s. 9d. due to M.L. and for the better securing the payment thereof has agreed to convey the Poole called the Isle poole to be excepted and reserved out of the several securities together with the capital messuage and lands and also a new erected messuage near the capital messuage to Margaret Lee. Now in consideration of the sum of £2,764 9s. 9d. so due and for better securing the payment thereof and in consideration of £100 T.S. grants and confirms to M.L. the premises in the mortgage with all the right, title and equity of redemption of T.S. in the premises; to hold to M.L. for the remainder of the term of 1000 years subject to the proviso aftermentioned; and T.S. as a further security for the repayment of the £2,864 9s. 9d. with interest, grants to M.L. the new erected messuage in Up Rossall and all other messuages and lands of T.S. in Up Rossall in his possession and in the possession of Edward Edwards; and the said water pond or pool called the Isle Poole; to hold to M.L. for 1000 years at a peppercorn rent at Michaelmas, if demanded; provided that if T.S. pays M.L. £2,979 0s. 11d. thus: £57 5s. 7d. on 1st February next and £2,921 15s. 4d. on 1st August next in 1746, then these presents shall be void; and T.S. covenants that he will pay the sums at the times stated; and that T.S. has full power to demise the premises to M.L.; and if he makes default in the payments M.L. may peacefully enter the premises free from incumbrances, and after breach of the proviso T.S. will at the request of M.L. at his cost make a further assurance in the law for conveying the property to M.L.
